RESOLUTION NO. 2008-26811 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA SUPPORTING HOUSE BILL 669 AND SENATE BILL 790 ENTITLED THE "JEFFREY JOHNSTON STAND UP FOR ALL STUDENTS ACT" WHICH PROHIBITS THE BULLYING OR HARASSMENT OF ANY STUDENT OR SCHOOL EMPLOYEE OF A PUBLIC K-12 EDUCATIONAL INSTITUTION; DIRECTING THE CITY ADMINISTRATION TO INCLUDE THE SUPPORT OF THESE BILLS IN THE CITY'S LEGISLATIVE PRIORITIES FOR THE 2008 FLORIDA LEGISLATIVE SESSION; AND DIRECTING THE CITY CLERK TO TRANSMIT THIS RESOLUTION TO GOVERNOR CHARLIE CRIST, THE PRESIDENT OF THE FLORIDA SENATE, THE SPEAKER OF THE FLORIDA HOUSE OF REPRESENTATIVES, AND THE MIAMI-DADE DELEGATION. WHEREAS, House Bill 669 and companion Senate Bill 790 entitled "The Jeffrey Johnston Stand Up for All Students Act" ("Act") prohibit bullying and harassment of students or school employees during educational programs and activities, on school buses, or through the use of data or computer software on computer systems of public K-12 public educational institutions; and WHEREAS, pursuant to the Act, each school district would be required to adopt a policy prohibiting bullying and harassment and to provide procedures for reporting and investigating such acts. Pursuant to HB 669 and SB 790, such policy would also require approval by the Department of Education in order for the school district to receive safe school funds; and WHEREAS, the Act is an important measure to address the destructive behaviors of bullying and harassment of public school students and employees; and WHEREAS, the Mayor and City Commission of the City of Miami Beach denounce bullying and harassment in Florida's public schools; and WHEREAS, specifically listing prohibited forms of harassment gives teachers and administrators clear guidelines as to the types of bullying and harassment they must address; and WHEREAS, House Bill 669 and Senate Bill 790 list harassment on race, sex, and religion as examples of harassment, but do not include examples of harassment based on disability, gender, gender identity, national origin, physical appearance, or sexual orientation. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Florida Legislature is hereby urged to adopt the "Jeffrey Johnston Stand Up for All Students Act" with an amendment that includes a prohibition on harassment based on disability, gender, gender identity, national origin, sexual orientation, ethnicity, and physical appearance. In addition, the City Administration is directed to include the support of these Bills, as amended, in the City's legislative priorities for the 2008 Florida legislative session, and the City Clerk is hereby directed to transmit this Resolution to Governor Charlie Crist, the President of the Florida Senate, and the Speaker of the Florida House of Representatives, and the Miami-Dade Delegation.
