2008-26791 ResoRESOLUTION NO. 2008-26791 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE SUPPLEMENT ONE TO THE JOINT PARTICIPATION AGREEMENT BETWEEN THE STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION AND THE CITY OF MIAMI BEACH, FOR SIGNALIZATION IMPROVEMENTS ON STATE ROAD AI A, AT 7T", 8TH' AND 9T" STREETS, PROVIDING ADDITIONAL FUNDING TO THE CITY IN THE AMOUNT OF $73,087, FOR ADDITIONAL EXPENSES INCURRED BY THE CITY RELATED TO THIS PROJECT WHEREAS, on December 20, 2000, the Mayor and City Commission adopted Resolution No. 2000-24221, approving the Ocean Drive Traffic Management Plan to implement transportation projects that would help improve mobility and better manage traffic congestion in and around the Ocean Drive area; the plan included street flow modification measures to better control and manage the vehicular traffic during late night, weekends, and special events, as well as increase the effectiveness of police enforcement; and WHEREAS, the change in the traffic flow warranted the installation of traffic control signals, as well as the reconfiguration of pavement striping and markings, and signage, at the intersections of these streets with Collins Ave, and these intersections are located within the Florida Department of Transportation (FDOT) right-of-ways; and WHEREAS, independent of this effort, FDOT also hired a consultant to conduct a signal warrant study at the intersection of 9th Street and Collins Avenue, and the study determined that a signal was warranted at that location, and that this work could be most efficiently completed along with the signalization of 7th and 8th Streets; and WHEREAS, on October 11, 2006, the Mayor and City Commission adopted Resolution No. 2006-26375, authorizing the City to enter into a Joint Participation Agreement (JPA) with FDOT, to allow the City to install the noted traffic signalization improvements, for snot-to-exceed amount of $726,757 (whereby FDOT agreed to reimburse the costs of this project); and WHEREAS, the City has now completed the construction work and the work has been approved and accepted by FDOT; and WHEREAS, the final cost of the project was $799,844, which exceeds the amount, provided in the JPA by $73,087; and WHEREAS, the Administration has additional funding, in the amount of $73,087, to cover all costs related to this project; and WHEREAS, the attached Supplement One to the Joint Participation Agreement provides for the additional funding, in the amount of $73,087. APPROVED AS TO FORM & LANGUAGE NOW, THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH hereby approve the execution of Supplement One to the Joint Participation Agreement between the State of Florida Department of Transportation and the City of Miami Beach, for Signalization Improvements on State Road A1A, at 7tn, Stn and 9th Streets, providing additional funding to the City in the amount of $73,087, for additional expenses incurred by the City related to this project. It was determined that 7th Street, between Ocean Drive and Washington Avenue, would be converted to a one-way eastbound street, and that 8th Street, between Ocean Drive and Washington Avenue, would be converted as a one-way westbound street. The change in the traffic flow warranted the installation of traffic control signals, as well as the reconfiguration of pavement striping and markings, and signage, at the intersections of these streets with Collins Ave. These intersections are located within the Florida Department of Transportation (FDOT) right-of-way. Independent of this effort, FDOT also hired a consultant to conduct a signal warrant study at the intersection of 9th Street and Collins Avenue. This study determined that a signal was warranted at that location, and that this work could be most efficiently completed along with the signalization of 7th and 8th Streets. On October 11, 2006, the Commission adopted Resolution 2006-26375 authorizing the City to enter an agreement with FDOT, to allow the City to install the noted traffic signalization improvements under a Joint Participation Agreement (JPA) for anot-to-exceed amount of $726,757. FDOT agreed to reimburse the costs of this project. Commission Memorandum Page 2 In order to expedite the traffic signalization improvements, the Resolution also approved the addition of design and construction services, in an amount not to exceed $726,757, for the traffic signalization improvements along Collins Avenue and 7th Stn and 9th Streets, as an amendment to the scope of services of the agreement with Ric-Man, Inc., for the Washington Avenue Improvements -Phases II, IV, and V Streetscape and Utility Improvement Project. The City has now completed the construction work satisfactorily and the work has been approved and accepted by FDOT. The cost of the project was $799,844, which exceeds the amount provided in the original Joint Participation agreement by $73,087. The City administration has negotiated additional funding in the amount of $73,087 to cover all costs related to this project. The original agreement will therefore be increased from $726,757 to $799,844 to fully fund the project. The attached Supplement One to the Joint Participation Agreement between the State of Florida Department of Transportation and the City of Miami Beach provides the additional funding in the amount of $73,087. signalization improvements along Collins Avenue and 7th 8th and 9th Streets are complete at this time; and, FDOT will own and maintain these improvements. This project supports the key intended outcome: Enhance mobility throughout the City. CONCLUSION This Resolution requests approval to execute the attached Supplement One to the Joint Participation Agreement between the State of Florida Department of Transportation and the City of Miami Beach which provides an additional amount of funding in the amount of $73,087 to the original agreement. Based on the aforementioned, the Administration recommends that the Mayor and City Commission adopt the Resolution authorizing the City Manager or his designee approval to execute supplement one to the Joint Participation Agreement between the State of Florida Department of Transportation and the City Of Miami Beach for signalization improvements on State Road A1A at 7th 8th and 9th Streets, providing additional funding to the city in the amount of $73,087, for additional expenses incurred by the City related to this project.
