A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, RATIFYING CONTRACT CHANGE ORDERS IN
THE TOTAL AMOUNT OF $119,065, TO FXP CORPORATION TO PROVIDE
FOR THE REPLACEMENT OF FIFTEEN (15) EXHAUST FANS AND INTAKE
VENTS, THREE (3) AIR HANDLING UNITS, AND SELECTED AIR
CONDITIONING SYSTEM AND AIR CONDITIONING UNITS AT THE
HISTORIC CITY HALL BUILDING.
WHEREAS, due to the age and deterioration of some of the HVAC system components
at Historic City Hall, located at 1130 Washington Avenue, there was a need to include the
replacement of the outside air duct system, filtration system, and HVAC fans in the development
of the Fiscal Year (FY) 2005/06 Capital Renewal and Replacement Projects Budget (the
Project); and
WHEREAS, on September 6, 2006, pursuant to Resolution No. 2006-26303, the City
Commission ratified a contract with FXP Corporation, in the amount of $ 117,000, for the
replacement of six (6) air handling units for Historic City Hall (the Project); and
WHEREAS, after further ongoing inspections, it was determined that an additional air
conditioning system and air conditioning units in the Police Communications Room required
replacement, as well as the replacement of three (3) air handling units, and fifteen (15) exhaust
fans and intake vents; and
WHEREAS, the Assistant Director of Public Works for Operations exercised the
authority delegated to him pursuant to Resolution No. 2007-26592 (authorizing the Assistant
Director to serve as the City's general contractor for the City's Capital Renewal and
Replacement Projects), and issued change orders to FXP Corporation, Inc., in the total amount
of $119.065, to accomplish the aforestated additional work; and
WHEREAS, the Administration recommends that the Mayor and City Commission ratify
the aforestated change orders to FXP Corporation, in the total amount of $119,065, to provide
for the replacement of fifteen (15) exhaust fans and intake vents, three (3) air handling units,
and selected air conditioning system and air conditioning units at Historic City Hall.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby ratify contract change orders to FXP Corporation, in the total amount of
$119,065, to provide for the replacement of fifteen (15) exhaust fans and intake vents, three (3)
air handling units, and selected air conditioning system and air conditioning units at Historic City
Hall.

Due to the age and deterioration of six (6) air handling units at the Historic City Hall Building, replacement
was included in the Fiscal Year (FY) 05/06 Capital Renewal and Replacement projects budget. FXP
Corporation was awarded the contract in the amount of $117,000, to complete this work (per Resolution
No. 2006-26303), in accordance with Request for Quotes (RFQ) No. VA-QT-01 M-006.
The Mayor and City Commission, atthe July 11, 2007 Commission meeting, adopted Resolution No. 2007-
26592, which authorized the Assistant Director of Public Works for Operations to serve as the Certified
General Contractor for all of the Fiscal Year (FY) 06/07 Capital Renewal and Replacement projects and
certain ongoing capital repairs, maintenance and replacement projects, including work at the Historic City
Hall. During the course of maintenance inspections of the building, it was determined that an additional air
conditioning system (ninth floor) had to be replaced, as well as additional units at the Police
Communication room, the replacement of three (3) air handling units and replacement of fifteen (15)
exhaust fans and intake vents. FXP submitted a proposal for the identified additional work. After the cost
proposal was determined to be fair and reasonable, the Assistant Director of Public Works for Operations
exercised the authority delegated to him by the City Manager and City Commission to issue change order
for completion of the additional work.
THE ADMINISTRATION RECOMMENDS ADOPTING THE RESOLUTION.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
FUNDING
Funding has been previously appropriated in the Fiscal Year (FY) 2005/06 Capital Renewal and
Replacement Budget Contingency.
ANALYSIS
Due to the age and deterioration of six (6) air handling units of the air conditioning system at
the Historic City Hall Building, their replacement was included in the Fiscal Year (FY)
2005/06 Capital Renewal and Replacement projects budget that was approved by the Mayor
and City Commission with the adoption of the Fiscal Year (FY) 2005/06 budget. FXP
Corporation was awarded the contract in the amount of $117,000, to complete this work (per
Resolution No. 2006-26303), in accordance with Request for Quotes (RFQ) No. VA-QT-01 M-
006.
The Mayor and City Commission, at the July 11, 2007 Commission meeting, adopted
Resolution No. 2007-26592, which authorized the Assistant Director of Public Works for
Operations to serve as the Certified General Contractor for all of the Fiscal Year (FY) 06/07
Capital Renewal and Replacement projects and certain ongoing capital repairs, maintenance
and replacement projects, including work on the Historic City Hall.

determined that additional HVAC work was required. It was determined that an additional air
conditioning system (ninth floor) had to be replaced, as well as additional units at the Police
Communication room. Further, based upon the inspection, the replacement of three (3) air
handling units, and fifteen (15) exhaust fans and intake vents were also recommended. Upon
request by the City, FXP submitted a cost proposal for additional HVAC work. After the cost
proposal was determined to be fair and reasonable, the Assistant Director of Public Works for
Operations exercised the authority given to him by the City Manager and City Commission to
issue change orders for the completion of the additional work.
