A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, RETROACTIVELY AUTHORIZING
THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE
AGREEMENT BETWEEN THE CITY OF MIAMI BEACH .AND
EVOLUTION FILM AND TAPE, INC. DEFT), DATED ON MARCH 6,
2006, FOR THE PRODUCTION OF A REALITY TELEVISION SERIES
ENTITLED "OCEAN FORGE"; AND FURTHER ACCEPTING THE
DONATION OF A "BOBCAT" BEACH VEHICLE FROM EFT.
WHEREAS, the City entered into an similar agreement with the Producer for the
Show on March 6, 2006 for a six episode series; and
WHEREAS, the City executed an amendment to the agreement with Evolution
Film and Tape ("Producer"), on March 5th 2008, for the production of a second eight
episode reality television series following the actions of the Miami Beach Ocean Rescue
for TruTV ("Network") entitled "Ocean Force: Miami Beach" ("Show"); and
WHEREAS, the City is to be compensated for the current (2008) production,
inclusive of the donation of a "Bobcat" .beach vehicle to the City at the conclusion of the
production for Miami Beach ocean Rescue purposes; and
WHEREAS, the City hereby accepts said donation and title transfer at the
conclusion of the production or June 30, 2008, whichever comes first, per attached
agreement.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, ,FLORIDA, retroactively authorizing
the City Manager to execute an amendment to the agreement between the City of Miami
Beach and Evolution Film and Tape, Inc., dated March 6, 2006, for the production of a
reality television series entitled "Ocean Force"; and further accepting the donation of a
beach vehicle.

Issue:
Since the original series aired Court TVwas purchased by Time Warnerwho subsequently changed the
name of the television network to TruTV. The series was also rebranded as "Ocean Force."~ EFT
approached the City again in 2007 with interest to produce a second series. The City has agreed to
amend the original agreement to allow for the production of an eight (8) episode series. The City will be
compensated Twelve Thousand Dollars ($12,000) per produced episode. EFT will also donate and
transfer title to the City a four (4) seat "Bobcat" beach vehicle valued at approximately Twelve Thousand
Dollars ($12,000). The City and EFT may mutually agree to extend the Term of the Agreement for the
production of a third production cycle of the Series. If a third cycle is mutual agreed to as per the terms of
the attached agreement, EFT will donate and transfer title to the City another beach or ocean rescue
vehicle and compensate the City in the amount of Fifteen Thousand Dollars ($15,000} per produced
episode.

FURTHER ACCEPTING THE DONATION OF A BEACH VEHICLE.
ADMINISTRATION RECOMMENDATION
Adopt the resolution.
ANALYSIS
In March 2006, the City of Miami Beach entered into an agreement (see attached) with
Evolution Film and Tape, Inc. (EFT) for the production of a reality television series entitled
Beach Patrol: Miami Beach. The Series chronicled the day-to-day duties of the Miami Beach
Fire Departmentlocean Rescue Division as they work in association with the Miami Beach
Fire Department, Miami Beach Police Department, and other Miami Beach City
Departments, and employees and officials to serve and protect citizens and visitors on the
City's public beaches.
In exchange for exclusive access to the Miami Beach Fire Department/Ocean Rescue
Division, EFT compensated the City in the amount of Five Thousand Dollars ($5,000} per
produced episode of the series and transferred title of a beach vehicle to the City for Ocean
Rescue's use (value = $10,000). A six (6) episode series was subsequently broadcast on
Court TV. A "Best of episode featuring segments from season 1 was also produced and
the City was compensated accordingly. EFT has entered into similar agreement with
Hawaii, San Diego, and Huntington Beach for the Beach Patrol Series.
Since the original series aired, Court TV was purchased by Time Warner, who subsequently
changed the name of the television network to TruTV. The series was also rebranded as
"Ocean Force." EFT approached the City again in 2007 with interest to produce a second
series. After several months of negotiations, the City has agreed to amend the original
agreement to allow for the production of an eight (8) episode series following the actions of
the Miami Beach Ocean Rescue Division for TruTV, entitled Ocean Force: Miami Beach.
The City will be compensated Twelve Thousand Dollars ($12,000) per produced episode.
EFT will also donate and transfer title to the City a four (4) seat "Bobcat" beach vehicle
valued at approximately Twelve Thousand Dollars ($12,000).

The agreement includes provisions for City review of factual content. Additional provisions
have been included to provide for public interest stories, and ensure the program accurately
reflects the City.
This nationally televised show provides excellent exposure for our City.
CONCLUSION
The Administration recommends the adoption of the attached Resolution.
