A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, IN
FURTHERANCE OF RESOLUTION NO. 2000-24196,
ADOPTED ON DECEMBER 20,2000, WmCH AUTHORIZED
AND DIRECTED THE CITY MANAGER AND CITY
ATTORNEY TO TAKE ALL NECESSARY ACTION TO
ASSURE THAT SUFFICIENT FUNDING BE AVAILABLE TO
MAINTAIN THE MIAMI BEACH CONVENTION CENTER
AND SUPPORTING FACILITIES AND FOR OTHER
ELIGmLE USES WITHIN THE CITY; PROVIDING THAT
ALL NECESSARY ACTION INCLUDE, BUT NOT BE
LIMITED TO, INVOCATION OF THE TERMINATION
PROVISIONS OF THE 1996 INTERLOCAL AGREEMENT
BETWEEN THE CITY OF MIAMI BEACH AND MIAMI-
DADE COUNTY WITH RESPECT TO THE CONVENTION
DEVELOPMENT TAX, THE PERFORMING ARTS CENTER
AND OTHER ISSUES.
WBEREAS, on March 20, 1996, the Miami Beach City Commission adopted Resolution No.
96-21927 authorizing the creation of an Interlocal Agreement (the "lnterlocal Agreement") between

the City and Miami-Dade County with respect to the Convention Development Tax (levied and
collected pursuant to Section 212,0305, Florida Statutes), the Performing Arts Center, and other
issues; and
WHEREAS, Section 212,030S(4)(b)(2)(a), Florida Statutes, provides that two-thirds (%)
of the Conve~tion Deve!ppment Tax "shall be used to extend, enlarge, and improve" the Miami Beach
Convention Center; and

WHEREAS, pursuant to the aforesaid Interlocal Agreement, the City has already agreed to
receive a reduced share of the Convention Development Tax in order to assist the County in funding
the Performing Arts Center; and
WHEREAS, the City of Miami Beach continues to support the Performing Arts Center
project under the terms and conditions of the Interlocal Agreement; and
WHEREAS, proposals have recently been placed before the Miami-Dade County
Cornmission to utilize the aforesaid Convention Development Tax proceeds to fund additional
projects; and
WHEREAS, the Miami Beach Convention Center is the major engine that drives the tourism
industry in Miami-Dade County and benefits the County's economy and all of its citizens; and

WHEREAS, it is necessary, desirable and in the best interests of all of the people of Miami-
Dade County that the City's share of the Convention Development Tax be protected and kept
available to assure that there will be sufficient future funding to maintain the Miami Beach Convention
Center and supporting facilities as a top quality state-of-the-art convention resource to attract major
conventions to Miami-Dade County, and for other eligible uses within the City, thus maximizing
tourism within the County; and
WHEREAS, on December 20, 2000, the Miami Beach City Commission adopted Resolution
No, 2000-24196, which authorized and directed the City Manager and City Attorney to take all
necessary action to assure sufficient funding be available to maintain the Miami Beach Convention
Center and supporting facilities and otherwise protect the City's interests; and
WHEREAS, a preliminary agreement on the future allocation of convention development tax
revenues has been discussed and drafted by and between the City of Miami Beach and Miami-Dade
County that would assure that sufficient funding be available to maintain the Miami Beach
Convention Center and supporting facilities and other eligible uses within the City, but has not yet
been approved; and
WHEREAS, the City of Miami Beach must assert its rights, as set forth in the Interlocal
Agreement, in a timely manner,
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Manager and
City Attorney are hereby authorized and directed to take such action as is necessary, including but
not limited to, invocation of the Termination Provisions of the 1996 Interlocal Agreement, to carry
out the intent of this Resolution, Resolution No, 2000-24169, and to protect the City's rights.
