any and all obligations under the terms of that certain agreement captioned: "MULTI-FAMILY REHABILITATION
PROGRAM MATCHING GRANT AGREEMENT", dated the 18"' day of June, 1999, and recorded on July 13, 1999 in
the Official Records ofMiami-Dade County at O.R. 18691, Page 3442, et.seq., and again in Official Records of Miami-
Dade County at O.R. 18691, Page 3458, et.seq which instrument affects the following described real property:
Lot 14 of Block 56, oi' NORMANDY SHORES GOLF COURSE SUBDIVISION, according to the plat
thereof recorded in Plat Book 44 at Page 62, of the Public Records of Miami-Dade County, Florida, also

Subject: RELEASE OF RESTRICTIVE COVENANT FOR CHALLENGER POINT
LLC. - 117 SOUTH SHORE DRIVE
On June 18, 1999 aMulti-Family Housing Rehabilitation Matching Program Agreement was
signed between the City and Joseph Barella, owner of 117 South Shore Drive, in the
amount of $37,000 for renovations at mentioned property. The program guidelines,
adopted by the Mayor and City Commission on July 16, 1997, required that buildings
rehabilitated be maintained in rental use for at least five years. In January 18, 2003 an
Assignment and Assumption Agreement was signed between the City and Challenger
Point, LLC upon Mr. Barella's death. Challenger Point, LLC is now requesting the City to
execute a release of lien.
The City Attorney determined that under the agreement, the City Manager is authorized to
conduct all transactions of the program including signing releases of liens. The Multi-
Family Housing Rehabilitation Matching Program funds are secured by a restrictive
covenant recorded with the Miami-Dade County Office of Circuit and County Court
Recorder. Therefore, please execute the attached Release of Restrictive Covenant and
return to the Housing and Community Development Division.
