RESOLUTION No. 2001-24331
A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING
THE THIRD AMENDMENT TO THE POLICE
CONFISCATION TRUST FUND FOR FISCAL YEAR 2000/01,
IN THE AMOUNT OF $305,567, TO BE FUNDED FROM THE
PROCEEDS OF STATE CONFISCATED FUNDS.
WHEREAS, Section 932.705, Florida Statutes, addresses the purpose and procedures to
be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and
WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need
for appropriation and expenditures exist and the appropriation and expenditure of forfeiture funds
is in compliance with Section 932.705, Florida Statutes; and
WHEREAS, such funds are available in the Police Confiscation Trust Fund.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby adopt the Third Amendment to the Fiscal Year 2000/01 Police Confiscation
Trust Fund Budget for the City of Miami Beach, in the amount of$305,567, as reflected in the
attached Exhibit "A".

THIRD BUDGET AMENDMENT
FISCAL YEAR 2000/01
STATE FUNDS:
CONTRIBUTION TO THE POLICE ATHLETIC LEAGUE: $17,100
Summer Jobs Program ($12,000): The Miami Beach Police Athletic
League Explorers consists of young adults sharing a common
interest in law enforcement. The Explorers get "hands on
experience" concerning law enforcement through their many
functions, some of which include traffic control, accident
investigation, crime prevention, security, field interrogations
and arrest procedures. During the summer months, the Police
Department hires the Explorers. This provides direction to the
Explorers, and the Department benefits from the additional
manpower which increases programming and saves overtime.
Police Explorer State Competitiou in Tampa, Florida, from June 24
through July 1, 2001 ($5,100).
PODIUM AND PUBLIC ADDRESS SYSTEM 2,200
CONTRIBUTION TO THE HISPANIC COMMUNITY
CENTER ENDOWMENT to help pay costs associated with
their Immigrant Youth Leadership Development Program. 25,000
REIMBURSEMENT TO THE GENERAL FUND FOR OVERTIME
incurred by officers assigned to the South Florida Money Laundering
Task Force during the second & third quarter of fiscal year 2000/01. 120,000
CRIME PREVENTION PROGRAMS - to increase funding of crime
prevention activities for which there is no other funding available:
To name a few: Citizens Police Academy, Business Crime and
Elderly Watch Program. 15,000
COLLAPSIBLE TENT SHELTER AND BANNER to be
used during outside events hosted by the Miami Beach Police
Department to protect the public and event from the inclement
weather. $1,225
POLICE ATHLETIC LEAGUE PROJECT
To provide additional funding to the PAL building renovation
for cost over runs. $32,596
SCAN (Security Communications Assistance Network) PROGRAM
This is a joint venture between the hotel businesses and the Police
Department geared toward deterring tourist related crimes. The officers
assigned to SCAN will carry an extra radio, providing them with direct
communication with all hotels belonging to the program. The program
will improve police response times, especially for high priority calls. It
will also foster a better relationship between the hotel community and the
Police Department. The program will provide us with extra eyes and ears
to detect criminal activity, resulting in increased security for our tourists
and other citizens visiting our hotels. The MBPD is expanding the
program to include forty additional hotels. $15,000
RODn D. BRICKELL ANTI-VIOLENCE PREVENTION PROJECT
to be implemented in Biscayne Elementary School. The implementation
of this program represents a partnership between the University of Miami
Medical Center for Child Adolescent Psychiatry, Miami-Dade School Board,
Biscayne Elementary and the Miami Beach Police Department. This program
is directed toward levels Kindergarten and First Grade. Funding is coming
from this Police Department with an equal match from the Rodd D.Brickell
Foundation. $6,000
NEW BOAT TO BE DOCKED AT THE NORTH BEACH SUB-STATION
This boat will be available to Patrol units on a 24-hour basis. This boat
will expand marine coverage by providing a vessel for the use of Patrol
units both when Marine Patrol is working and more important when they
are not. $25,000
ADOPT A BRIDGE CAMPAIGN - To apply Graffiti solution System
to the bridges ofthe North District. One bridge of that area will be
selected as a test side. If the MBPD obtains good results of the anti-
graffiti paint, the project will continue with the rest ofthe bridges of
the area. $5,000

hereby certify that the aforementioned proposed request for

provisions of Section 932.705(3) (a), Florida Statutes.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
Florida Statute 932.705 provides for expenditures of forfeiture funds for law enforcement purposes.
The Chief of Police of the City of Miami Beach has reviewed and identified the need for the
appropriation and has established that the expenditures of forfeiture funds is in compliance with
Section 932.705, Florida State Statutes. These forfeiture funds have been deposited in the Police
Confiscation Trust Fund. The City has complied with all statutory procedures involved in the
transaction of these funds.
The Administration requests authorization to adopt the Third Amendment to the operating budget
for the Police Confiscation Trust Fund for Fiscal Year 2000/01 and to appropriate $305,567 from
State Funds to provide for the expenditures listed in Exhibit "A".
