96-22026 RESO RESOLUTION No. 96-22026 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE SIXTH AMENDMENT TO THE POLICE CONFISCATION TRUST FUND FOR FISCAL YEAR 1995/96, IN THE AMOUNT OF $143,000, TO BB FUNDED FROM THE PROCEEDS OF CONFISCATED FUNDS ($25,000 FROM STATB FUNDS AND $118,000 FROM FEDERAL FUNDS) WHEREAS, section 932.705, Florida Statutes, addresses the purposes and procedures to be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need for expenditures and appropriation exists and the expenditure or appropriation of forfeiture funds is in compliance with section 932.705, Florida Statutes, and with Federal guidelines; and WHEREAS, such funds are available in the Police Confiscation Trust Fund. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City commission hereby adopt the sixth Amendment to the 95/96 Police Confiscation Trust Fund Budget for the city of Miami Beach, in the amount of $143,000, as reflected in the attached Exhibit "A". POllCE CONFISCATION TRUST FUND SIXTH BUDGET AMENDMENT FISCAL YEAR 95/96 STATE FUNDS: D. A. R. E. - The curriculum has changed for DARE requiring the Department to purchase new and additional items in order to keep the program continued 10,000 ACCREDITATION - The MBPD has requested funds in the 96/97 Budget to continue to proceed with the Accreditation process. Prior to obtaining these funds, the Department has and will incur in expenses publications, meetings, travels and application package. 5,000 Additional funds for reimbursement for protective vests. The Contract between the City and the FOP provides that the City reimburse officers up to$450.00 for a bullet resistant protective vest. 10,000 SUB-TOTAL FOR STATE FUNDS $25,000 FEDERAL FUNDS: OfT-Set printing of the Miami Beach Police Department 1995 Annual Report $3,000 Park Security Program - This is a cooperative project between the Police Department and the Recreation, Culture and Parks Dept. developed to provide an additional level of security to our residents, tourists and day guests utilizing various parks throughout the City. For more information see attached Exhibit "B" 80,000 Design and plans for construction ofRCC (Report Control Center) 15,000 Changes and additions to Police Department Access Control Installation 20,000 (Original appropriation approved under the 3rd Amendment) SUB- TOTAL FOR FEDERAL FUNDS $118,00 GRAND TOTAL $143,000 EXHIBIT" A" CITY OF MIAMI BEACH PARKS SECURITY PROGRAM * Is a cooperative project between the Police Department and Recreation, Culture and Parks Department developed to provide an additional level of security to OUf residents, tourists and day guests utilizing various parks though out the City. The Recreation, Culture and Parks Department contributes $80,000 and Police $80,000. Total services will not exceed 5160,000. * Security is provided by Annor Security, unarmed, radio dispatched, coordinated with the support of the Police Department * Initiated on the Boardwalk as a test site in January of 1996, was detennined to be successful and the program was then expanded. Current sites are as follows: Boardwalk 2 guards North Shore Open Space Park 2 guards (including Altos Del Mar) North Shore Park 1 guard Flamingo Park 2 guards 6th Street Community Center 1 guard Sam to 9 am and 5 pm to 1 am 7 days per week 168 hrs. per week 7 pm to 2 am 7 days per week 98 hrs. per week 3-10 pm Monday-Friday 1-10 pm Saturday-Sunday 53 hrs. ADM:IN:IS'l'RAT:ION REC~AT:ION Approval of the Resolution. BACKGROUND Expenditure of forfeiture funds for law enforcement purposes under the federal guidelines is a proper expenditure. Florida Statute 932.705 provides for, but is not limited to, expenditure of forfeiture funds for crime prevention and other law enforcement purposes. The Chief of Police of the City of Miami Beach has determined that the need for expenditures and appropriation exist and the expenditure or appropriation of forfeiture funds is in compliance with Section 932.705, Florida Statutes. CONCLUS:ION The proper procedure has been complied with in accordance with Florida State statute 932.705. In accordance with Florida statute 932.705, forfeiture funds have been deposited in the Police Confiscation Trust Fund and all other statutory procedures have been complied with. Forfeiture funds have been collected pursuant to Asset Sharing Agreements with various Federal agencies pursuant to 18 USA 981(e)2; 21 USA 881(e) (1) (A) and (e) (3); and/or 19 USA 1616a and have been deposited in the Police confiscation Trust Account.
