A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, RATIFYING A CONTRACT AND CHANGE ORDER
TO ARTEK CONSTRUCTION MANAGEMENT CORP., TO PROVIDE FOR
REPAIRS OF THE PERIMETER FENCE AND INTERIOR AND EXTERIOR
PAINTING AT THE FLAMINGO POOL COMPLEX, IN THE TOTAL AMOUNT
OF $57,100; WITH FUNDING FROM THE PREVIOUSLY APPROPRIATED
FISCAL YEAR (FY) 2006/07 CAPITAL RENEWAL AND REPLACEMENT
BUDGET.
WHEREAS, due to the age and deterioration of the perimeter fence and interior and
exterior of the Flamingo Pool, there was a need to provide for their repair; and
WHEREAS, the Property Management Director exercised the authority delegated to him
pursuant to Resolution No. 2006-26400 (authorizing the Property Management Director to serve
as the City's general contractor for the City's Capital Renewal and Replacement Projects) and
developed specifications to address the scope of work that was necessary to obtain price
quotes from fencing and painting contractors for repairs to the perimeter fence and interior and
exterior painting at the Flamingo Pool complex; and
WHEREAS, three (3) fencing and painting contractors were contacted to provide quotes
for the Project, which resulted in three (3) responsive quotes; and
WHEREAS, after reviewing the quotes, the Property Managment Director determined
that Artek Construction Management Corp. provided the lowest responsive, responsible quote;
and
WHEREAS, a contract was issued to Artek Construction Management Corp., in the
amount of $28,100, to provide for repairs to the perimeter fence and interior and exterior
painting at the Flamingo Pool complex; and
WHEREAS, during the course of the repair of the perimeter fence, additional repair work
was warranted; and
WHEREAS, as it was determined that it was in the best interest of the City to continue to
work with Artek Construction Management Corp. to complete the additional fence repairs and
exterior and interior painting, cost proposals for the additional work were requested from the
company; and
WHEREAS, the Property Managment Director issued change orders to Artek
Construction Management Corp., in the total amount of $29,000, to accomplish the aforestated
additional work; and
WHEREAS, the Administration recommends that the Mayor and City Commission ratify
the aforestated contract and change order to Artek Construction Management Corp. in the total
amount of $57,100, to provide for repairs to the perimeter fence and interior and exterior
painting at the Flamingo Pool complex.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby ratify a contract and change order to Artek Construction Management Corp.
to provide for repairs to the perimeter fence and interior and exterior painting at the Flamingo
Pool complex, in the total amount of $57,100; with funding for the work from the previously
appropriated Fiscal Year (FY) 2006/07 Capital F~enewal and Replacement Budget.

Item Summary/Recommendation:
The Mayor and City Commission, at the December 6, 2006 Commission meeting, adopted Resolution No.
2006-26400, which authorized the Property Management Director to serve as the Certified General
Contractor for all of the Fiscal Year (FY) 2006/07 Capital Renewal and Replacement projects and certain
ongoing capital repairs, maintenance and replacement projects. The Property Management Director
exercised the authority given to him by the City Manager and City Commission and developed
specifications and contacted three (3) fencing and painting contractors to provide bids on the project that
resulted in three (3) responsive responsible bids. After reviewing the bids, and after checking background
references, licensing, and insurance requirements, the Property Management Director determined that
Artek Construction Management Corp., provided the lowest responsive responsible bid for the Project.
After review by the Legal Department and execution by the Mayor and City Clerk, a contract was issued to
Artek Construction Management Corp., in the amount of $28,100 for the work. During the course of the
replacement of the main electrical components, it was determined that the additional replacement of the
associated air handling unit electrical components was warranted. It was determined that it was in the best
interest of the City to perform additional work with Artek Construction Management Corp. After the cost
proposal was determined to be fair and reasonable, the Property Management Director exercised the
authority delegated to him by the City Manager and City Commission to issue change order in the amount
of $29,000, for completion of the additional work.
The Administration recommends that the Mayor and Members of the City Commission ratify the Property
Management Director's contract award and change order to Artek Construction Management Corp.

ADMINISTRATION RECOMMENDATION

FUNDING
Funding has been previously appropriated in the Fiscal Year (FY) 2006/07 Capital Renewal and
Replacement Budget.
ANALYSIS
The Mayor and City Commission, at the December 6,2006 Commission meeting, adopted

for Quotations No.VA-QT7F-07. Three (3) fencing and painting contractors were contacted to
provide bids on the project that resulted in three (3) responsive responsible bids (See
Attachment 1). After reviewing the bids, and after checking background references, licensing,
and insurance requirements, the Property Management Director determined that Artek
Construction Management Corp provided the lowest responsive responsible bid for the Project.
After review by the Legal Department and execution by the Mayor and City Clerk, a contract
was issued to Artek Construction Management Corp., in the amount of $28,100 for the work.

During the course of the project, it was determined that the additional repairs to the damaged
perimeter fence panels were necessary. As it was determined that it was in the best interest of
the City to perform additional work with Artek Construction Management Corp., a cost proposal
for the additional work was requested. After the cost proposal was determined to be fair and
reasonable, the Property Management Director exercised the authority given to him by the City
Manager and City Commission to issue a change order in the amount of $29,000, for the
completion of the additional work.
Since the contract award was not yet ratified, the Administration recommends that the Mayor and
Members of the City Commission ratify simultaneously the issuance by the Property Management
Director of a contract award and change order to Artek Construction Management Corp., in the total
amount of $57,100, to provide for repairs of the perimeter fence and interior painting at the Flamingo
Pool Complex.
