2008-26837 ResoRESOLUTION NO. 2008-26837 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE AMENDMENT NO. 2 TO THE AGREEMENT BETWEEN THE CITY AND RIC-MAN INTERNATIONAL, INC., DATED DECEMBER 6, 2006, PURSUANT TO INVITATION TO BID NO. 36- 05/06 FOR THE DESIGN, PERMITTING, CONSTRUCTION AND CONSTRUCTION MANAGEMENT ASSOCIATED WITH NEIGHBORHOOD N0.7 - NAUTILUS RIGHT-OF-WAY INFRASTRUCTURE IMPROVEMENT PROJECT, IN AN AMOUNT NOT TO EXCEED $749,130.00; SAID AMENDMENT FOR THE PROVISION OF ADDITIONAL DESIGN, PERMITTING, AND CONSTRUCTION NECESSARY FOR BIKE LANES AND ROUTES ON PRAIRIE AVENUE, ROYAL PALM AVENUE, NORTH BAY ROAD, 44TH STREET, AND 47TH STREET TO PROVIDE NORTH-SOUTH AND EAST-WEST CONNECTIONS; WITH FUNDING FROM PREVIOUSLY APPROPRIATED PEOPLE'S TRANSPORTATION PLAN (PTP) FUNDS. WHEREAS, on December 6, 2006, the Mayor and City Commission adopted Resolution No. 2006-26423, approving and authorizing the Mayor and City Clerk to execute aDesign -Build Agreement with Ric-Man International, Inc. (Ric-Man), pursuant to Invitation to Bid No. 36-05/06, for the Design, Permitting, Construction and Construction Management Associated with Neighborhood No. 7 -Nautilus Right-of-Way Infrastructure Improvement Project (Project) (Agreement); WHEREAS, the Agreement includes proposed improvements for the Project based upon a Design Criteria Package (DCP) and the Basis of Design Report prepared by the City's A/E consultant, Reynolds, Smith, and ,Hills, Inc., including earthwork, roadway narrowing, milling and resurfacing, driveway paving, sidewalk construction, water main installation, water services relocations, storm drainage infrastructure installation, roadway lighting, and streetscape /planting improvements; and and WHEREAS, the Agreement was executed for a Lump Sum Price of $27,110,222; WHEREAS, on October 17, 2007, pursuant to Resolution No. 2007-26692, the Mayor and City Commission approved Amendment No. 1 to the Agreement, in the amount of $6,369,544; and WHEREAS, Amendment No. 1 increased the total Agreement fee by $6,369,544 for a total fee of $33,479,766; and WHEREAS, the Public Works Department has requested the design, permitting and construction of new bike lanes and routes in the Nautilus Neighborhood, on Prairie Avenue, Royal Palm Avenue, North Bay Road, 44th Street, and 47th Street, which will provide North-South and East-West connections in Middle Beach and connect to the proposed bikeways in Bayshore Neighborhood and La Gorce Neighborhood; and WHEREAS, the total cost to design and construct the bike lanes and bike routes is $749,130; and WHEREAS, this item was referred by the Commission to the Finance and Citywide Projects Committee, which recommended it for approval by the Commission. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the Mayor and City Clerk to execute Amendment No. 2 to the Agreement between the City and Ric-Man International, Inc., dated December 6, 2006, pursuant to Invitation to Bid No. 36-05/06 for the design, permitting, construction, and construction management associated with Neighborhood No.7 -Nautilus Right-Of-Way Infrastructure Improvement Project, in an amount not to exceed $749,130.00; said Amendment for the provision of additional design, permitting, and construction necessary for bike lanes and routes on Prairie Avenue, Royal Palm Avenue, North Bay Road, 44th Street, and 47th Street, to provide North-South and East- West connections; with funding from previously appropriated People's Transportation Plan (PTP) funds from Fiscal Year (FY) 2006/07, in the amount of $249,067, and FY 2007/08, in the amount of $500,063. The purpose of the AGN was to: (1) create a continuous trail network; (2) support multimodal transportation; (3) link bicycle and pedestrian destinations; (4) increase pedestrian and bicycle safety; (5) improve trail network connectivity; (6) eliminate barriers that prevent bicycle trips; and (7) develop future bikeway corridors. City staff underwent an intensive public involvement process with various city, county, and state stakeholders to refine the AGN, and on October 17, 2007, City Commission adopted the AGN. Concurrently, the Department of Public Works requested the design, permitting, and construction of new bike lanes and routes in the Nautilus Neighborhood. The Nautilus Neighborhood bike lanes on Prairie Avenue, Royal Palm Avenue, 44th Street, and 47th Street will provide north-south and east-west connections in Middle Beach. These bike lanes are included in the adopted Atlantic Greenway Network Master Plan and will connect to the proposed bikeways in Bayshore Neighborhood and La Gorce Neighborhood. This GMP did not address any bicycle facilities. These facilities were planned outside of the BODR process and were not included in the DCP. The majority of the cost to perform this work includes new roadway cross-sections, new signage and new pavement markings. Upon Commission approval of this resolution, CIP will execute the a ro riate contract amendment with Consultant. ADMINISTRATIVE RECOMMENDATION Adopt the Resolution. FUNDING From previously appropriated PTP funds in the FY 2006/07 Capital Budget in the amount of $249,067 and $500,063 from the FY 2007/08 Capital Budget. ANALYSIS The Neighborhood No. 7 -.Nautilus Right-of-Way Improvements Project (Project) is located in Middle Beach and is bounded by Surprise Waterway to the north, Biscayne Bay to the west, Pine Tree Drive to the east, and State Road 112/Arthur Godfrey Road (W. 41 st Street) to the south. The improvements being made in the Project are included in the Basis of Design Report for Neighborhood No. 7 -Nautilus and a Design Criteria Package (DCP) prepared by Reynolds, Smith and Hills, Inc. The DCP includes conceptual specifications and plans for the civil, electrical, mechanical, structural and landscaping disciplines. On June 23, 2006, the City's Procurement Division issued Invitation to Bid (ITB) No. 36- 05/06 for Design/Build Services for Neighborhood No. 7 -Nautilus Right-of-Way Infrastructure Improvement Project. The purpose of this ITB was to obtain bids from qualified General Contractors to provide all Design/Build services for Nautilus Neighborhood No. 7. On October 11, 2006, the Mayor and City Commission authorized the Administration to enter Commission Memorandum -Nautilus Bike Lanes June 25, 2008 Page 2 of 4 into negotiations with the firm of Ric-Man International, Inc. (Ric-Man), as the best and lowest bidder. Ric-Man submitted a bid in the amount of $27,110,222, pursuant to ITB No. 36-05/06. The City evaluated the bid submitted by Ric-Man and found it to be appropriate and in accordance with the required scope and timeline. On December 6, 2006, the City Commission authorized the execution of an Agreement with Ric-Man in the amount of $27,110,222, with an additional $2,700,000 for contingency, authorized by Resolution No. 2006-26423, for a total of $29,810,222. On October 17, 2007, this was amended to a Guaranteed Maximum Price (GMP) in the amount of $33,479,766 as the need for additional stormwater improvements became apparent as had been mentioned in the Risk Assessment Plan (RAP). These items include additional stormwater pump stations, discharge wells and piping, and unknown conditions including the need to remove organic material and replace it with suitable fill material. This GMP did not address any bicycle facilities. These facilities were planned outside of the BODR process and were not included in the DCP. Planning and development of a Bicycle/Pedestrian Master Plan entitled the Atlantic Greenway Network (AGN) began in 2005. The purpose of the AGN was to create a continuous trail network, support multimodal transportation, link bicycle and pedestrian destinations, increase pedestrian and bicycle safety, improve trail network connectivity, eliminate barriers that prevent bicycle trips, and develop future bikeway corridors. On December 6, 2006 the Mayor and City Commission adopted Resolution No. 2006-26399 approving a professional services agreementwith The IBI Group pursuantto RFQ 19-04/05, for the Programming, Design, Construction Documents, Permitting, Bid and Award and Construction Management Services for the AGN. City staff underwent an intensive public involvement process with various city, county, and state stakeholders to refine the AGN. The following meetings identify the public involvement process taken, with various stakeholders and their respective comments to the project. Bikeways Committee -June 27, 2007 Representatives from the Florida Department of Transportation (FDOT) and Miami-Dade County (MDC) attended this meeting. Both FDOT and MDC representatives and the Bikeways Committee endorsed the project. Internal Staff Meeting -June 27, 2007 Staff from the Planning Department, CIP, and Neighborhood Services attended the meeting. Staff provided input regarding safety, improvements to the proposed routes, and coordination with other City projects. Community Workshop- August 30, 2007 Twenty-two (22) members of the community and eight (8) representatives from City, County and State departments attended the meeting. There was general support for the project, and suggestions were provided for improving the proposed facilities. Several residents expressed concerns regarding the timeline and funding of the proposed projects. Commission Memorandum -Nautilus Bike Lanes June 25, 2008 Page 3 of 4 Transportation and Parking Committee (TPC) -September 10, 2007 The TPC passed a motion endorsing the project, with the requirement that bike paths are to be demarcated for separate bicycle and pedestrian travel and that bicyclists are not allowed on the Boardwalk from 21St Street to 46t Street. Neighborhoods /Community Affairs Committee -September 19, 2007 The Neighborhoods /Community Affairs Committee endorsed the project. Planning Board -September 25, 2007 The Planning Board endorsed the project and stressed to include signage and consider safety in all bicycle projects. On October 17, 2007, the City Commission Adopted the Resolution to approve The Miami Beach Atlantic Greenway Network Master Plan. Public Works subsequently requested the design, permitting and construction of new bike lanes and routes in the Nautilus Neighborhood. The Nautilus Neighborhood bike lanes on Prairie Avenue, Royal Palm Avenue, 44th Street, and 47th Street will provide north-south and east-west connections in Middle Beach. These bike lanes are included in the adopted Atlantic Greenway Network Master Plan and will connect to the proposed bikeways in Bayshore Neighborhood and La Gorce Neighborhood. The Streets that will have Bike Lanes /Routes are as follows: 1) Designated Bike Lanes - Royal Palm from 42nd Street to 47th Street; 47th Street from Pine Tree Drive to North Bay Drive; 44th Street from Prairie Avenue to Pine Tree Drive; and Prairie Avenue from 41st Street to 44th Street; 2) Bike Routes -North Bay Road from Alton Road to West 48th Street. As the Nautilus project was already under construction, CIP had to negotiate an amendment with Ric-Man to include these improvements in the Project. The total cost to design and construct the Nautilus Neighborhood bike lanes was finally negotiated to be $749,130. Construction of some bike lanes in the Orchard Park area has already begun in order to expedite construction completion of the streets and the new pavement. The majority of the cost to perform this work includes new roadway cross-sections, new signage and new pavement markings. Widening of the roadway as needed to accommodate bike lanes (Royal Palm, W 44 ST, and W 47 ST) requires the following: ^ Excavation of the right-of-way adjacent to edge of pavement on both sides of the road from 2 to 4 feet to accommodate the additional 1 to 3 feet of roadway. ^ An 8"limerock base installed the width of the widened roadway plus an additional 6" to support the edge of pavement. ^ Swales graded by small bobcat and hand graded with rakes to transition to new edge of pavement and to prepare for sod. ^ Driveways to be saw cut if asphalt or concrete. ^ Driveway aprons either completely replaced if stamped concrete or if elevation change was significant, otherwise transitioned halfway up the apron to new edge of pavement. ^ 1 to 2 inches of asphalt placed over compacted limerock matching slope of cross- section or 2% minimum. Commission Memorandum -Nautilus Bike Lanes June 25, 2008 Page 4 of 4 Sod placed in areas where swale transition required it and/or were damaged by construction. ^ Trees which were in conflict with widening or too close to roadway by regulatory standards were removed or relocated. ^ Limits of Final Milling and Resurfacing extended to include new widened roadways. This item was reviewed by the Commission at the May 14, 2008 meeting and staff was directed to investigate potential cost reductions in the implementation of the bike lane plan within the Nautilus Neighborhood and to also identify other Neighborhoods where the implementation of the bike lanes plan would require pavement expansion into the swale area. Recommendations included the possible elimination of bike lanes. The Commission then referred this item for further discussion at the May 29, 2008 Finance and Citywide Projects Committee Meeting. At the May 29tH Meeting, it was represented by Staff that, following consultations with the contractor and program manager, it was determined that $11,220 could be saved by not installing the signs needed to create a bicycle route on North Bay Road. The City could also reduce the number of signs proposed along the bicycle lanes for an additional savings of $6,475. No other savings could be obtained within the Nautilus Neighborhood at this time, since most of the work has already been performed in this project. It was also reported that, as of the current design status of the other Neighborhood Projects, only the bicycle lanes on 28tH Street required reclaiming part of the swale area. Following discussion by Committee members, the following determinations were made: ^ Nautilus Neighborhood: In consideration that the majority of the Nautilus Lanes had been constructed and there were minimal opportunity for cost reductions, the Nautilus Bike Lane Improvements were recommended for approval. Nevertheless, members of the Committee asked staff to calculate the cost of removing the already constructed bike lanes and restoring the swales. 28tH Street: Staff was directed to eliminate one of the two bicycle lanes and to narrow the traffic lanes to accommodate minimal requirements. The consultant will be directed to proceed accordingly and to complete a design for a single bike lane on the south side of 28tH Street. Staff estimates that approximately one foot of swale reclamation will be required to accommodate a single bike lane design that meets minimal requirements. ^ Other Locations: Staff was directed to continue working on designs that do not require widening of roads to accommodate bicycle lanes and to not widen any other roads to accommodate bicycle lanes without Commission approval. CONCLUSION The Administration recommends approval of the attached Resolution, authorizing the Mayor and City Clerk to execute an amendment with Ric-Man for the construction of the bicycle facilities in the Nautilus Neighborhood using previously appropriated People's Transportation Plan "PTP" funds.
