96-22037 RESO RESOLUTION NUMBER 96-22037 A RESOLUTION OF THE MA VOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE AWARD OF A PURCHASE ORDER IN THE AMOUNT OF $17,115 TO OHM REMEDIATION SERVICES CORPORATION FOR THE COMPLETION OF THE REQUIRED GROUNDWATER MONITORING OF THE DIESEL FUEL CONTAMINATED AREA AT THE MIAMI BEACH CONVENTION CENTER. WHEREAS, the Dade County Department of Environmental Resources Management (DERM) has required the performance of a quarterly groundwater quality monitoring of the diesel fuel contaminated area at the Miami Beach Convention Center; and WHEREAS, the environmental consultant who was hired by the responsible contractor to conduct the required testing went out of business before completing the work; and WHEREAS, personnel changes at Spectacor Management Group have left it without anyone knowledgeable about the environmental issues at the Convention Center; and WHEREAS, the DERM is pressuring the City, as the property owner, to complete the required testing; and WHEREAS, the City will have the work completed and charge the costs to the Convention Center Department Account; and WHEREAS, the Administration recommends the proposed work be performed via the existing environmental services agreement between the DERM and the proposed contractor. NOW, THEREFORE, BE IT DUL V RESOLVED BV THE MA VOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the award of a purchase order to OHM Remediation Services Corporation in the amount of $17,115 to provide for required environmental services is approved. THE FUNDS ARE AVAILABLE IN THE CONVENTION CENTER DEPARTMENT ACCOUNT. ADMINISTRATION RECOMMENDATION SUBJECT: Approve the resolution. BACKGROUND The soil and groundwater beneath one the southern loading docks at the Convention Center became contaminated with diesel fuel when the underground storage tank for the emergency generator was accidentally damaged by a contractor working at the facility. The responsible contractor subsequently hired a consultant to replace the damaged tank and to conduct a contamination assessment. Based on the findings the assessment, the Dade County Department of Environmental Resources Management (DERM) required the implementation of a quarterly groundwater quality monitoring program for one year. The monitoring plan was implemented in October of 1994. Unfortunately, the monitoring stopped after only two of the required four quarterly sampling events. Apparently, the consultant, who was hired by the responsible party, went out of business before completing the work and the contractor failed to hire another. Because the DERM is pressuring the City (as the property owner) to complete the required testing, the Administration proposes to have the work completed and charge the City's costs to the Convention Center Department Account. Additionally, the Administration has requested the City Attorney's Office to seek the recovery of the costs from the responsible party. CONCLUSION The City Commission should authorize the award of a purchase order in the amount of $17,115 to OHM Remediation Services Corporation for the completion of the required groundwater monitoring of the diesel fuel contaminated area at the Convention Center.
