A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC HEARING
FOR SEPTEMBER 10, 2008 TO RETROACTIVELY WAIVE THE
DEVELOPMENT REGULATIONS FOR THE CONSTRUCTION OF A
TEMPORARY PARKING LOT IN COLLINS PARK TO TEMPORARILY
REPLACE LOST PARKING WHILE THE LOT IS RENOVATED,
PURSUANT TO SECTION 142-425(d) OF THE CITY CODE.
WHEREAS, the Collins Park Improvements project, which includes a complete
renovation of Collins Park, adjacent streets, and the East Parking Lot, located on Collins
Avenue between 21st and 22"d Streets, is approaching the start of construction; and
WHEREAS, the contractor has received the first notice to proceed and is in the
process of finalizing permitting activities; and
WHEREAS, it is anticipated that the second notice to proceed for construction
mobilization will be issued by late July, 2008 construction activities should commence in the
month of July, 2008; and
WHEREAS, due to the different aspects of the project, the Capital Improvement
Projects Office (CIP) has developed a phasing schedule for the project with the contractor that
takes into consideration the Art Basel event; and
WHEREAS, the second phase of the project will be the renovation and improvements
of Collins Park proper and also surrounding streets to match the improvements previously
completed for the Regional Library, the Miami City Ballet, and the Bass Museum; and
WHEREAS, the prospect of even a temporary reduction in public parking was
anticipated by staff during the pre -construction coordination efforts and meetings with
stakeholders and surrounding property owners were held and efforts made to mitigate the
impact from the temporary loss of parking; and
WHEREAS, during the past weeks, City staff has been meeting with area stakeholders
to facilitate an understanding of the Collins Park Project construction impacts and made some
arrangements to accommodate the businesses in the area; and
WHEREAS, new objections to the temporary loss of public parking were raised during
the July 2, 2008 Project Pre -construction Public Meeting by area residents, some property and
hotel owners, the Art Basel representative, and the Collins Park Neighborhood Association; and
WHEREAS, pursuant to this most recent public input, the CIP Office began to explore
the possibility of creating a temporary parking lot in the area west of Collins Ave., within Collins
Park, and in front of the Bass Museum; and
WHEREAS, the Collins Park property is zoned GU, Government Use and Sec. 142-422
of the City of Miami Beach Code lists parking lots as one of the main permitted uses and
Section 130-70, "Temporary parking lot standards", states that temporary parking lots may be
operated in the GU government use district; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission hereby adopt
a resolution for the purpose of setting a Public Hearing for September 10, 2008 to consider
retroactively waiving the development regulations for the construction of a temporary parking
lot in Collins Park to temporarily replace lost parking while the lot is renovated, pursuant to
section 142-425(d) of the City Code.

Item Summary/Recommendation:
The Collins Park Improvements project is approaching the start of construction. The first phase of the project
will be the total reconstruction and improvement of the East Parking Lot. This part of the project is scheduled
to be completed within four months of construction beginning. The second phase of the project will be the
renovation and improvements of Collins Park proper.
Objections to the temporary loss of public parking were raised during the July 2, 2008 Project Pre -construction
Public Meeting by area residents, some property and hotel owners, the Art Basel representative, and the
Collins Park Neighborhood Association. A temporary parking lot could be designed to accommodate a total of
one hundred and twenty (120) parking spaces, of which one hundred and fifteen (115) would be regular spaces
and five (5) would be handicap parking spaces that would comply with ADA standards in the area west of
Collins Ave., within Collins Park. The Collins Park property is zoned GU, Government Use. Sec. 142-422 of
the City of Miami Beach Code lists parking Tots as one of the main permitted uses. Should the Commission
desire to construct a parking facility, for the very limited time contemplated, and should there be a desire to
save funds by not constructing the parking lot to the temporary parking lot standards, certain waivers from the
City Code will be required. Development regulations required by the City Code, except for the historic
preservation and design review processes, may be waived by a five -sevenths vote of the city commission The
waivers would be for provisions found in Section130-70(2) and Section 130-70(8), paving materials and
landscaping.
Under this scenario, then the projected scope of work would include the following; removal of existing sod
material from an approximate area of 37,000 square feet, the placement, grading, and compaction of a four
inch (4") layer of crushed rock, parking striping and symbols to accommodate the 120 parking spaces, and
removal of the temporary parking lot upon completion of the East Collins Parking Lot renovations. A proposal
for the above option has been secured from the project contractor, in the negotiated amount of $42,600.
Funding for this option has been previously appropriated in Parking Operations Fund 480. In the event that the
Mayor and City Commission do not waive the development regulations, but authorize the construction of a
temporary parking lot, additional funds, in the not -to -exceed amount of $103,770 would need to be
appropriated from Parking Operations Fund 480, for a total not -to -exceed amount of $146,370.

Adopt the Resolution.
FUNDING
Funding for the increased cost of constructing a temporary parking lot is available from
previously appropriated funds in Parking Operations Fund account 480-2398-069357 for
construction. In the event that the Mayor and City Commission do not waive the
development regulations, but authorize the construction of a temporary parking lot, additional
funds, in the amount of $103,770 would need to be appropriated from Parking Operations
Fund account 480-2398-069357.
ANALYSIS
The Collins Park Improvements project, which includes a complete renovation of Collins
Park, adjacent streets, and the East Parking Lot, located on Collins Avenue between 21st
and 22" Streets, is approaching the start of construction. The contractor has received the
first notice to proceed and is in the process of finalizing permitting activities. It is anticipated
that the second notice to proceed for construction mobilization will be issued by late July,
2008 and construction activities should commence in the month of July, 2008.
Due to the different aspects of the project, the Capital Improvement Projects Office (CIP)
has developed a phasing schedule for the project with the contractor. Anticipating the return
of the Art Basel event and the ArtPositions placements in the vicinity of the East Parking lot,
the first phase of the project will be the total reconstruction and improvement of the East
Parking Lot. This part of the project is scheduled to be completed within four months of the
second notice to proceed. Once the East Parking Lot is renovated, the completion of the
improvements in Miami Beach Drive will follow. If these improvements are determined as
impinging on Art Basel, that part of the project will be postponed until the festival is
completed. Metro Express, the Collins Park project contractor, understands the importance

of the Art Basel event to the City and is aware that he may be required to demobilize
construction activities for a few days to accommodate event related activities. The Rotunda,
within Collins Park, will also be renovated during this time. The temporary parking lot is to be
constructed so that the Rotunda exterior construction will not impact parking.
The second phase of the project will be the renovation and improvements of Collins Park
proper, and also surrounding streets to match the improvements previously completed for
the Regional Library, the Miami City Ballet, and the Bass Museum. As a part of phase two,
the temporary parking lot will be demolished. The entire park will be closed from 22nd Street
to Collins Avenue to 21St Street to just east of the Bass Museum building. Pedestrian access
will be maintained on both 21St and 22nd Streets as well as Collins Avenue. No road closures
are anticipated during any phase of the project. Any temporary lane closures will be
minimized and appropriate barriers and directional devices will be used as part of an
approved Maintenance of Traffic Plan.
The prospect of even a temporary reduction in public parking was anticipated by staff during
the pre -construction coordination efforts. Meetings with stakeholders and surrounding
property owners were held and efforts made to mitigate the impact from the temporary loss
of parking. During the past weeks, City staff has been meeting with area stakeholders to
facilitate an understanding of the Collins Park Project construction impacts and to make
some arrangements to accommodate the businesses in the area. The major stakeholders
such as the W Hotel, the Days Inn, the Regional Library, the Bass Museum and the Miami
City Ballet have agreed that the arrangements made with CIP with respect to the Collins
Park project are satisfactory and that the scheduling of the parking lot improvements at this
time is acceptable. The W Hotel, expected to be in construction through May, 2009, has also
made independent arrangements by leasing a private lot at Alton Road and 7th Street. In
consideration of the W's construction activities, the City had previously arranged for a
construction staging and unloading area east of the rock wall along Miami Beach Drive.
Additionally, as part of the Collins Park project, efforts will be made during construction along
Miami Beach Drive to maintain a limited number of available parking spaces.
The closing of the parking lot was factored into the project's construction sequencing and
schedule. However, new objections to the temporary loss of public parking were raised
during the July 2, 2008 Project Pre -construction Public Meeting by area residents, some
property and hotel owners, the Art Basel representative, and the Collins Park Neighborhood
Association. Pursuant to this most recent public input, the CIP Office began to explore the
possibility of creating a temporary parking lot in the area west of Collins Ave., within Collins
Park, and in front of the Bass Museum. This would be a similar approach taken at other
projects wherein the City has constructed temporary parking Tots, when possible, to mitigate
temporary loss of public parking during the construction of City projects. A letter from the
Collins Park Neighborhood Association supporting a temporary parking lot is attached as
Attachment 4.
The Collins Park property is zoned GU, Government Use. Sec. 142-422 of the City of Miami
Beach Code lists parking lots as one of the main permitted uses. Additionally, Section 130-
70, "Temporary parking lot standards", states that temporary parking lots may be operated
in the GU government use district. Section 130-70(2) of the City Code requires that a
temporary parking lot include no less than one inch of asphalt over a four -inch limerock
base. Section 130-70(8) "Landscaping Requirements" of the Code requires a landscape
plan that, at minimum, indicates a five foot wide landscaped area bordering the surface area
along a property line, street, alley or sidewalk; one canopy tree every 20 feet of frontage; a

hedge that is at least 36 inches in height at the time of planting; and an in -ground irrigation
system that covers 100 percent of the landscaped areas.
The recommended temporary parking lot could be designed to accommodate a total of one
hundred and twenty (120) parking spaces, of which one hundred and fifteen (115) would be
regular spaces and five (5) would be handicapped parking spaces that would comply with
ADA standards. The temporary parking would then be removed after the East Parking Lot is
completed, and ahead of the construction of the Collins Park improvements (See
Attachment 1). It is estimated that construction time of the East Parking Lot should last four
months. Once the East Parking Lot is completed, barring no anticipated conflict with Art
Basel, the contractor will immediately mobilize on the west of Collins phase of the project. As
a part of that phase, the temporary parking lot will be demolished and the renovation and
improvements will begin in the Park.
Should the Commission desire to construct a temporary parking lot, for the very limited time
contemplated, and should there be a desire to save funds by not constructing the parking lot
to the temporary parking lot standards, certain waivers from the City Code will be required.
Pursuant to Section 142-145 (d), following a public hearing, the development regulations
required by the City Code, except for the historic preservation and design review processes,
may be waived by a five -sevenths vote of the City Commission for developments pertaining
to governmental owned buildings, uses and sites which are wholly used by, open and
accessible to the general public. The waivers would be for provisions found in the
previously -cited Section130-70(2) and Section 130-70(8).
Should the authorization be received to proceed to construct the temporary parking lot with
the recommended waivers, then the proposed project would be submitted to regulatory staff
for their review and administrative approval that would lead to a Certificate of
Appropriateness. Given the short construction period for the East Parking Lot, and the
construction window of opportunity, prior to Art Basel, staff would recommend that under this
scenario, authorization be issued to retroactively waive the previously -cited development
regulations at a subsequent public hearing, during the September 10, 2008 Commission
Meeting, and to proceed into construction following the finalization of the on-going permitting
process. The projected scope of work with the recommended waivers would include the
following:
• Removal of 4" bottom layer and sod from an approximate area of 37,000 square feet,
• The placement, compaction, and grading of a four inch (4") layer of crushed rock,
• Application of parking striping and symbols to accommodate the 120 parking spaces,
and
• Removal of the temporary parking lot upon completion of the East Parking Lot
renovations.
A proposal for the above option, which essentially waives the requirements for asphalt and
landscaping, has been secured from Metro Express, the Collins Park project contractor, in
the negotiated amount of $42,600, including the JOC fees (See Attachment 2). The parking
wheel stops and signage will be provided and installed by the City.
Conversely, construction of a temporary parking lot in compliance with Section 130-70(2)
and Section 130-70(8), would require additional funding, in the amount of $103,770, for an
estimated total un -negotiated amount of $146,370. Under this option, a public hearing would
not be required.

Should the Commission elect to not construct the temporary parking lot within Collins Park,
then the project would proceed into construction as planned, following the completion of the
on-going permitting activities. A projected schedule for construction of a temporary parking
lot with the recommended waivers is attached (See Attachment 3).
It should be noted that in order for the East Parking Lot to be completed in time to not
interfere with Art Basel, that construction must commence by the end of July to the first week
in August. We will not be able to delay construction beyond this and still meet the Art Basel
schedule.
Therefore, depending upon the decision of the City Commission, with regard to the
temporary parking lot, it is anticipated that construction activities will commence by August
8th at the latest. If the temporary lot is approved, either with or without waivers, construction
will commence between July 31st and August 8, 2008. The first planned activity will be the
construction of the temporary parking lot, if approved.
CONCLUSION
The Administration recommends the adoption of a resolution setting a Public Hearing for
September 10, 2008 to retroactively waive the development regulations for the construction
of a temporary parking lot in Collins Park to temporarily replace lost parking while the lot is
renovated, pursuant to Section 142-425(d) of the City Code.

On July 2nd, 2008, the CIP office held a pre -construction meeting with the community to
discuss the demolition and building of the long awaited and anticipated new Collins Park. This
also includes a complete makeover of the parking lot to the East of Collins Avenue. For years
the plan proposed was in 3 phases and that is what was approved by the Collins Park Cultural
Oversight Committee and what was accepted by our Association. We have always been
concerned about closing the entire parking lot at the same time and were assured many times
over this would not happen. However, that is exactly what was proposed on July 2nd and based
on timing, it is the only solution to insure the parking lot element will be complete for Art
Basel.
At the meeting I specifically asked if temporary parking could be added someplace on the site
while the parking lot was being redone and was told by CIP it had to meet code relative to
lighting, paving etc. It is a temporary 3 to 4 month lot. Surely some kind of exception can be
made for this neighborhood already extremely short of parking? You, as the director of the
Parking Department, can present an alternative solution to the Commission to provide parking
relief to the Collins Park Neighborhood while the park is rebuilt. CPNA supports and asks you
to pursue temporary parking in an area suitable on the west side of Collins Avenue.
The only other thing that we ask is that you also insure that the temporary parking will be
available for Art Basel should the permanent lot not yet be opened. This is the number one
yearly event in Collins Park, the one that has stimulated development and recognition of Collins
Park as the third destination within South Beach. This also proves the necessity of bringing the
South Beach Local to Collins Park. We are pleased that the Transportation & Parking
Committee is finally taking up this issue again and are confident a positive resolution will
emerge.
Undoubtedly, the park makeover will be a fantastic boost for our neighborhood and we all want
it. Thirteen months of construction sounds much better than the 18 to 24 months originally
projected. We just want to insure minimal disruption to our Neighborhood. Providing
temporary parking will ease, if not eliminate, the pain of construction. Thank you for your
