Gonzalez \ . ~ City Manager d t'" U Setting of Public Hearings - Proposed Amendments to the Official Zoning Map TO: SUBJECT: A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SETTING PUBLIC HEARINGS TO CONSIDER PROPOSED AMENDMENTS TO THE OFFICIAL ZONING DISTRICT MAP, REFERENCED IN SECTION 142-72 OF THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, BY CHANGING THE ZONING DISTRICT CLASSIFICATION FOR THOSE TEN AREAS IDENTIFIED IN THE CHART BELOW AND THE MAPS ATTACHED TO THIS RESOLUTION; BY AMENDING THE AFFECTED PORTIONS OF THE CITY'S OFFICIAL ZONING DISTRICT MAP TO REFLECT THE CHANGES REFLECTED BELOW AND ATTACHED. ADMINISTRATION RECOMMENDATION The Administration recommends that the City Commission set the required public hearings for a time certain on March 14,2001 for this proposed amendment to the Official Zoning Map ANALYSIS In January, 1994 the City approved numerous Comprehensive Plan and Future Land Use Map amendments rezoning properties throughout the City, including properties described on Attachment "A" and shown on maps referenced as Attachment "B", however, at that time the corresponding amendments to the Zoning Map were not made. Following is a timeline of these events: . 12/2/93 - The Planning Board, sitting as the Local Planning Agency, met to review and consider a draft amendment to the Miami Beach Comprehensive Plan, including changes to the Future Land Use Map, as referenced in Attachment "A" and shown on maps referenced as Attachment "B" . 1/6/94 - The City Commission approved the transmittal of the draft 1994 Comprehensive Plan Amendments to the State of Florida Department of Community Affairs. AGENDA ITEM C 7 t.( DATE s-/~-Ol Commission Memorandum May 16,2001 Setting Public Hearingsfor Zoning Map Changes Page 2 ANALYSIS (Continued) . 6/2/94 - City Commission adopted by Ordinance No. 94-2928 the amendments to the Comprehensive Plan. . 10/9/96 - City Commission re-adopted by Ordinance No. 96-3058 pursuant to a Compliance Agreement, the 1994 amendments to the Comprehensive Plan. Planning Department staff reviewed the Comprehensive Plan and the Future Land Use Map changes made in 1994 and recommended to the Planning Board that a redesignation of the zoning classification on the subject properties, as further described in Exhibit" A" and shown on Exhibit "B", would provide consistency with the as-built character of the immediate areas without creating any significant negative impacts on the surrounding neighborhoods, and would be consistent with the public health, safety and welfare. The existing designations are inconsistent with the future land use designations of the subject properties, and are also inconsistent with the existing conditions of the properties surrounding these areas. Further, the proposed amendments should not adversely influence living conditions in the neighborhoods, as the character of the neighborhoods would not be adversely affected. Lastly, rezoning these areas will harmonize the Official Zoning Map with the Future Land Use Map, thereby eliminating any confusion that might arise from the dual designation ofthese areas. The subject amendments require a 30-day mailed notice of public hearing for those areas that are less than 10 contiguous acres. Parcels of land involving ten contiguous acres or more, require two advertised public hearings on the proposed ordinance, with at least one hearing held after 5 :00 p.m. The public notice shall be advertised in a newspaper of general circulation in the city which is published at least five days a week, at least 7 days before the hearing date; the second notice shall be advertised at least 5 days prior the second public hearing. To enable the City Commission to hold a public hearing on the proposed amendments in a timely manner at its June 6, 200 I meeting, the Administration is requesting that the public hearings be set at this time. Based on the foregoing, the Administration recommends that the City Commission set the required first and only public hearing regarding the proposed amendment to the Official Zoning Map for those parcels of land of less than 10 contiguous acres, and first reading for those parcels of land involving 10 contiguous acres or more, as referenced above and more particularly set forth in the attach~IUtion, for June 6, 2001, at 10:30 a.m. JMG\JGG\ML attachments F:IPLAN\$PLBIMA Y\200l I l497MAPICCSET -HR.
