2001-24379 RESO RESOLUTION NO, 2001-24379 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, RETROACTIVELY APPROVING REQUEST FOR CHANGE ORDER NO, 1 WITH REGOSA ENGINEERING INC, IN THE AMOUNT OF $53,500, FOR THE PROVISION OF LABOR, MATERIALS, EQUIPMENT, AND SERVICES NECESSARY TO INSTALL NEW ELECTRICAL SERVICES TO THE FLAMINGO PARK TENNIS CENTER, THE BOYS AND GIRLS CLUB BUILDING AND THE FLAMINGO PARK PROMENADE; AND APPROPRIATING FUNDS, IN THE TOTAL AMOUNT OF $53,500, FROM THE FLAMINGO PARK GENERAL OBLIGATION (G,O,) BOND FUND (PHASE II) INCLUDED IN THE $92 MILLION GENERAL OBLIGATION (GO) BOND, SERIES 2000, FUND NUMBER 374 TO PAY FOR THE ADDITIONAL WORK; AND FURTHER INCREASING THE TIME ALLOWED UNDER THE CONTRACT BY FIVE (5) CALENDAR DAYS TO COMPLETE THE ADDITIONAL WORK, WHEREAS, on January 31, 2001, the Mayor and the City Commission, adopted Resolution Number 2001-24253, authorizing the award of a contract in the amount of $2,639,780 to Regosa Engineering, Inc. for the construction of the Flamingo Park Pool Facility Project; and the Phase I improvements are currently underway; and WHEREAS, the Parks and General Obligation Bond improvements to the Flamingo Park is comprised of two (2) phases; and WHEREAS, the Flamingo Park Phase I encompasses the demolition of the former pool building and the construction of a new aquatic facility, including a new 8 lanes pool, an interactive water playground pool, landscaping and irrigation; and WHEREAS, Phase 11 includes the general improvements to the remaining components of the park, such as the tennis center, the playground, the courts, and enhancement of the park's general lighting; and WHEREAS, the current Florida Power and Light ("FP&L") transformers, located in a vault, underneath the pool building feed the Tennis Center, the park promenade and the Boys and Girls Club building with the needed electrical power; and WHEREAS, as a result of the Flamingo Park Phase I improvements the existing vault is scheduled to be demolished and the transformers relocated; and WHEREAS, in the Fall of 2000, the Administration, in anticipation of the necessary relocations, authorized FP&L to proceed with the initial phase of the work, and it resulted in the relocation of the underground conduits that were located west of the pool building, and the installation of a new overhead transformer on Michigan Avenue, to feed electrical power to the new pool facility; and WHEREAS, it is necessary at this time to complete the work associated with the relocation of the remaining transformers, as they relate to the facilities included in the Flamingo Phase 11; and WHEREAS, City staff, the City's consultants, and FP&L representatives have held a series of meetings and have conducted various site visits to discuss the relocation of the current transformers in the vault and to minimize the down time during the transfer of electrical services for the three aforementioned facilities; and WHEREAS, a change order to perform this work was negotiated with Regosa Engineering, Inc., by the City's Program Manager, URS Corporation; and WHEREAS, URS Corporation issued its recommendation to the City requesting acceptance of the proposal, and City staff, after reviewing the proposal concurred with URS Corporation that the quantities, rates and additional time to perform this extra work are reasonable; and WHEREAS, funding in the total amount of $53,500, is available from the Flamingo Park General Obligation Bond Fund (Phase II), included in the $92 Million General Obligation Bond Series 2000, Fund No. 374. WHEREAS, On May 9, 2001, the Administration, in order to avoid delays in the schedule for the completion of the project authorized the contractor, through the City's consultants to proceed with the work. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City Commission hereby authorize the Mayor and City Clerk to retroactively approve Request for Change Order No. 1 with Regosa Engineering Inc. in the amount of $53,500, for the provision of labor, materials, equipment, and services necessary to install new electrical services to the Flamingo Park Tennis Center, the Boys and Girls Club building and the Flamingo Park promenade; and appropriating funds, in the total amount of $53,500 from the Flamingo Park General Obligation (G.O.) Bond Fund (Phase 11), included in the $92 Million General Obligation Bond, Series 2000, Fund Number 374 to pay for the additional work; and further increasing the time allowed under the contract by five (5) calendar days to complete the additional work. The budget for the construction of the first phase is $2,639,780, and the estimated budget for the construction of the second phase is $2,141,245. On January 31, 2001, the Mayor and the City Commission, adopted Resolution Number 2001-24253, authorizing the award of a contract in the amount of$2,639, 780. to Regosa Engineering, Inc. for the construction of the first phase of the project, which is currently underway. Part of the Phase I improvements include the demolition of a Florida Power and Light ("FP&L") vault located undemeuth the pool building. The FP&L transformers, located in the vault, feed the Tennis Center, the park promenade and the Boys and Girls Club building with the needed electrical power. City staff, the City consultants and FP&L representatives have held a series of meetings and have conducted various site visits to discuss the relocation of the current transformers and to minimize the down time during the transfer of electrical services for the three (3) aforementioned facilities. As a result, in the fall of 2000, the Administration, in anticipation, authorized FP&L to proceed with the initial phase of the work. Then, the underground conduits, west of the pool building, were relocated. A new overhead transformer was installed, on Michigan A venue, to feed electrical power to the new pool facility. It is necessary at this time to complete the work associated with the relocation of the transformers, as they relate to the facilities included in the Flamingo Park improvements Phase II, and ensure that the power necessary to service the current and future facilities are in place. After further discussion with FP&L and the City's consultants, the Administration authorized URS Corporation, the City's Program Manager, to negotiate a change order to perform this work with Regosa Engineering, Inc. Subsequently, Regosa Engineering Inc. submitted its proposal to the City's consultants Corradino Group and URS Corporation. After negotiation with the contractor, URS issued a letter to the City recommending the acceptance of the proposal (Attached). City staff reviewed the proposal and concurs with URS Corporation that the quantities, rates and additional time to perform this extra work are reasonable. On May 9,2001, the Administration, in order to avoid delays in the schedule for the completion of the project authorized the contractor, through the City's consultants to proceed with the work.
