96-22067 RESO RESOLUTION NO. 96-22067 A RESOLUTION AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO RECEIVE AND PROCESS ANY PETITIONS FOR INITIATIVES AND REFERENDUMS, TO ENTER INTO A MANAGEMENT AGREEMENT WITH THE LINCOLN ROAD PARTNERSHIP, TO NEGOTIATE A CONTRACT TO ACQUIRE THE BUILDING LOCATED AT 1833 BAY ROAD FOR THE PURPOSE OF PROVIDING ADDITIONAL OFFICE SPACE, AND TO SIGN ALL REQUIRED CONTRACTS, AGREEMENTS, PURCHASE ORDERS, AND CHANGE ORDERS THAT MAY AFFECT THE HEALTH, SAFETY, OR WELFARE OF THE CITY, FROM THE LAST COMMISSION MEETING IN JULY, 1996 UNTIL THE FIRST COMMISSION MEETING IN SEPTEMBER, 1996, SUBJECT TO RATIFICATION BY THE CITY COMMISSION AT ITS FIRST MEETING IN SEPTEMBER, 1996. WHEREAS, the Mayor and City Commission are not scheduled to meet between the last meeting in July, 1996 and the first meeting in September, 1996; and WHEREAS, the Mayor and City Commission historically have, during such periods in past years, assigned certain powers to the City Manager subject to ratification by the City Commission; and WHEREAS, there are no Commission Meetings between the last meeting in July, 1996 and the first meeting in September, 1996; and WHEREAS, the City Manager will report back to the City Commission, at the first meeting in September, 1996, seeking ratification of any actions relating to the aforestated authorizations. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the City Manager, or his designee, is hereby authorized to Receive and Process Any Petitions for Initiatives and Referendums, to Enter into a Management Agreement with the Lincoln Road Partnership, to negotiate a contract to Acquire the Building Located at 1833 Bay Road for the Purpose of Providing Additional Office Space, And to Sign All Required Contracts, Agreements, Purchase Orders, and Change Orders That May Affect the Health, Safety, or Welfare of the City, from the Last Commission Meeting in July, 1996 until the First Commission Meeting in September, 1996, Subject to Ratification by the City Commission at its First Meeting in September, 1996. ADMINISTRA nON RECOMMENDATION: It is recommended that the City Commission authorize the City Manager, or his designee, to receive and process any petitions for Initiatives and Referendums, to enter into a management agreement with the Lincoln Road Partnership, to negotiate a contract to acquire the building located at 1833 Bay Road for the purpose of providing additional office space, and to sign all required contracts, agreements, purchase orders, and change orders that may affect the health, safety, or welfare of the City, from the last Commission meeting in July, 1996 until the first Commission meeting in September, 1996, subject to ratification by the City Commission at its first meeting in September, 1996. BACKGROUND: Between the last meeting in July, 1996 and the first meeting in September, 1996, the City Commission will not be in session. During this period of time there may be contracts which may need to be awarded, and which may be in excess of the $10,000 limitation. Additionally, there may be projects which may need timely action. The City Commission historically has, during such periods in past years, assigned certain powers to the City Manager subject to ratification by the City Commission. It is therefore requested that the City Manager, or his designee, be authorized to receive and process any petitions for Initiatives and Referendums, to negotiate a contract to acquire the building located at 1833 Bay Road for the purpose of providing additional office space, and to sign all required contracts, agreements, purchase orders, and change orders that may affect the AGENDA ITEM C 1 0 DATE 1- r7~q~ health, safety, or welfare of the City, from the last Commission meeting in July, 1996 until the first Commission meeting in September, 1996, subject to ratification by the City Commission at its first meeting in September, 1996. CONCLUSION: Since this authorization is necessary to ensure that essential services and projects continue during the period between the last Commission meeting in July, 1996 until the first Commission meeting in September, 1996, it is recommended that the City Commission approve this request.
