TO THE EXISTING PRECONSTRUCTION SERVICE AGREEMENT
BETWEEN
THE CITY OF MIAMI BEACH, FLORIDA
AND
COASTAL CONSTRUCTION COMPANY,
DATED MAY 10, 2006,
FOR ADDITIONAL PRE-CONSTRUCTION SERVICES IN AN AMOUNT NOT-
TO-EXCEED $25,356, DURING DESIGN OF A REPLICA CLUB HOUSE AND
THE COMPLETE DEMOLITION OF THE EXISTING CLUB HOUSE AT THE
NORMANDY SHORES GOLF COURSE,
T is A endment No. 3 to the Agreement made and entered this ~3 ~ay of
2008, by and between the CITY OF MIAMI BEACH, a
Municipal Corp ration existing under the laws of the State of Florida, having its
principal offices at 1700 Convention Center Drive, Miami Beach, Florida 33139
(hereinafter referred to as City), and COASTAL CONSTRUCTION COMPANY, a
Florida corporation whose address is 5959 Blue Lagoon Drive, Suite 200 Miami,
Florida, 33126 (hereinafter referred to as CM).
RECITALS
WHEREAS, on May 10t", 2006, in accordance with Resolution No. 2006-
26197, the Mayor and City Commission approved an Agreement for Pre-
Construction Services with Coastal Construction Company, to provide value
engineering, constructability, and cost estimating assistance for the construction
of the new Normandy Shores Golf Course cart barn building; the renovation of
the maintenance building and construction of a new chemical storage building
and sand containment bins; the construction of two restroom buildings; and the
renovation of the club house (the project) and
WHEREAS, on May 10t", 2006, in accordance with Resolution No. 2006-
26197, the Mayor and City Commission approved Amendment No. 2-A to the
Agreement for partial demolition services at the club house; and
WHEREAS, this partial demolition exposed structural problems and
existing conditions that differed from record drawings; and
WHEREAS, the City believes it to be more cost effective and less subject
to delay if .the existing structure- is demolished and a replica club house is built;
and
WHEREAS, the City and Coastal Construction Company have negotiated
the following amendment, in amount not to exceed $25,356, for the additional
aforestated pre-construction services.
NOW, THEREFORE, the parties hereto, and in consideration of the mutual
promises, covenants, negotiated agreements, terms and conditions herein
contained, and other good and valuable consideration, the respect and adequacy
are hereby acknowledged, do agree as follows:
1. ABOVE RECITALS
The above recitals are true and correct and are incorporated as part of this
Amendment No.3.
2. MODIFICATIONS
The Agreement is amended to include Attachment IV (not applicable to
Amendment No.3) and Attachment V, attached and incorporated hereto.
3. OTHER PROVISIONS
All other provisions of the Agreement, remain unchanged and in full force
and effect.
4. RATIFICATION
The City and CM ratify the terms of the Agreement, as defined by this
Amendment No.3.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment
No. 3 to be executed in their names by their duly authorized officials as the
date first set forth above.
