A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, RESCINDING THE AWARD OF BID
NO. 38-95/96 ENTITLED, "ALTON ROAD LANDSCAPE IMPROVEMENT
PROJECT, PHASE II", TO REED LANDSCAPING, INC., AND AWARDING
THE BID TO THE SECOND LOWEST BIDDER, PHILCORP LANDSCAPE,
INC.; FURTHER AUTHORIZING THE ADMINISTRATION AND CITY
ATTORNEY'S OFFICE TO PURSUE FORFEITURE OF THE BID BOND OF
REED LANDSCAPING, INC.
WHEREAS, on January 4, 1996, the City issued Invitation to Bid Number 38-95/96
entitled, "Alton Road Landscape Improvement Project, Phase II" (the Bid); and
WHEREAS, on May 15, 1996, the Mayor and City Commission awarded the Bid
to Reed Landscaping, Inc.; and
WHEREAS, pursuant to the terms of the Bid, Reed Landscaping, Inc. was required
to execute the City's Contract for work on the Project no later than ten (10) calendar days after the
date on which the Notice of Award had been issued by the City; and
WHEREAS, the City remitted a Notice of Award letter to Reed Landscaping, Inc.
on May 22, 1996; and
WHEREAS, on June 17, 1996, the City's Purchasing Division contacted Reed
Landscaping, Inc. to pick up its Contract for execution; and
WHEREAS, on July 8, 1996, Reed Landscaping, Inc. verbally informed the City's
Purchasing Division that it had not been able to obtain bonding for the Project and therefore would
not be able to accept the award of the Bid; and
WHEREAS, in lieu of Reed Landscaping, Inc's. failure to timely execute its Contract
with the City, pursuant to the requirements of the Bid, the Administration would recommend that
the City rescind its May 15, 1996 award of the Bid to Reed, and herein approve the award of the Bid
to the second lowest bidder, Philcorp Landscape, Inc.; and
WHEREAS, it is also recommended that the Mayor and City Commission authorize
the Administration to work with the City Attorney's Office and pursue forfeiture of the Bid Bond
of Reed Landscaping, Inc.
NOW THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the award of Bid No. 38-
95/96 entitled, "Alton Road Landscape Improvement Project, Phase II", to Reed Landscaping, Inc.
is hereby rescinded and that the Administration is authorized to award the Bid to the second lowest
bidder, Philcorp Landscape, Inc. The Administration is further authorized to pursue forfeiture of the
Bid Bond of Reed Landscaping, Inc., in conjunction with the City Attorney's Office.

Request for Authoriza 'on to Rescind the Award of the Contract to Reed
Landscaping, Inc., in the Amount of $141,047.95, (Forfeiture of their Bid Bond
as Liquidated Damages for Failure to Execute the Contract under the
Conditions of their Proposal and placement on the suspended bidders list for a
period of one year.), and Award a Contract to the Second Lowest Bidder,
Philcorp Landscape, Inc., in the Amount of $143,320, Pursuant to Bid No. 38-
95/96 for Alton Road Landscape Improvement Project, Phase II; further
request for Authorization to Pursue Forfeiture of the Bid Bond of Reed
Landscaping, Inc., through the City's Legal Department.
ADMINISTRATION RECOMMENDATION:
Rescind the award of bid to Reed Landscaping, Inc., and approve award to Philcorp Landscape,
Inc.
CONTRACT AMOUNT AND FUNDING:
$143,320.00
Funds are available from Budget Account No. 366.2114.069358. 50% of
funding is from the Florida Highway Beautification Program Grant and 50%
is from a donation from the Miami Heart Institute.
BACKGROUND:
This project was awarded to Reed Landscaping, Inc. on May 15, 1996, Commission Memorandum
No. 277-96, Agenda Item R-2-A. On May 22, 1996, the City remitted a Notice of Award letter to
Reed Landscaping, Inc. Contract Books were assembled and on June 17, 1996, the Purchasing
Division notified Reed Landscaping, Inc. by telephone to pick up the Contract Documents, execute
the Contract and complete the Performance and Payment Bonding requirements.

As of July 8, 1996, the Contract Books had not been picked up. A second telephone call was placed
by AI Sprigle, Asst. Director of Procurement, to Iris Reed, President of Reed Landscaping, Inc., who
informed him that they could not provide the Performance Bond for this project and therefore would
not be able to accept this award. It was requested that Iris Reed put this information in writing so
that the Administration could request City Commission approval to award to the second lowest
bidder for this project, but no written communication has been received as of this date.
CONCLUSION:
Based on the attached Findings and Determinations, it is recommended that the City Commission
rescind the award of this project to Reed Landscaping, Inc., authorize the award to the second lowest
bidder, Phil corp Landscape, Inc., and place Reed Landscaping, Inc. on the suspended bidder list for
a period of one year.
