A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, APPROVING AN AUTHORIZING THE CITY MANAGER TO
EXECUTE SUBSTANTIALLY IN THE FORM ATTACHED TO THIS RESOLUTION,
AMENDMENT NO 2 TO THE AGREEMENT, DATED MARCH 19, 2015, BETWEEN
THE CITY, THE MIAMI-DADE COUNTY SCHOOL BOARD, AND FLORIDA
INTERNATIONAL UNIVERSITY TO PROVIDE DUAL ENROLLMENT COURSES FOR
COLLEGE CREDIT FOR 11TH AND 12TH GRADE STUDENTS ATTENDING MIAMI
BEACH SENIOR HIGH SCHOOL; SAID AMENDMENT, IN MATERIAL PART,
EXTENDING THE TERM OF THE AGREEMENT TO JUNE 30, 2018, AND
INCREASING THE CITY'S CONTRIBUTION TO THE PROGRAM, IN AN AMOUNT
NOT TO EXCEED $62,000 PER FISCAL YEAR, COMMENCING WITH THE THIRD
YEAR OF THE PROGRAM (2017-2018 SCHOOL YEAR), SUBJECT TO BUDGET
APPROPRIATION.
WHEREAS, the Education Compact (Education Compact) with Miami-Dade County
Public Schools (M-DCPS), established on January 16, 2008, includes the outcome to Achieve
K-12 education excellence; and
WHEREAS, the Education Compact reflects the desire of the Miami Beach community
to support excellence in the City's public schools to improve educational opportunities for youth;
and
WHEREAS, in order to increase academic support and achievement, the Education
Compact seeks to identify and pursue the implementation of best practices strategies to
increase the graduation rate at Miami Beach Senior High School (MBSH); and
WHEREAS, the graduation rate at Miami Beach Senior High School in 2016 was 82.5%,
which represents a 16.2% increase from 2011; however, overall M-DCPS graduation rates
improved to 80.4% in 2016, a 12.76% increase from 2011; and
WHEREAS, dual enrollment programs enrich the course opportunities for outstanding
high school students and save students and parents money; and
WHEREAS, dual enrollment is a program that allows eligible high school students
currently attending accredited Miami-Dade County public or private high schools, or home
schools, to enroll in a college course and high school course simultaneously. The credits that
students earn must be applicable toward a high school diploma or a postsecondary educational
title, such as a college associate, baccalaureate degree or a technical certificate; and
WHEREAS, students in the 11th and 12th grades that are enrolled in M-DCPS are
eligible to participate in the dual enrollment programs and must meet specific criteria; and
WHEREAS, Florida International University (FIU) currently offers 100 dual enrollment
courses in approximately 35 out of 63 high schools across Miami-Dade County; and
WHEREAS, due to state funding changes for dual enrollment courses in July 2013,
individual high schools are responsible for reimbursing colleges for instructor and administrative
fees; therefore, the number of courses offered is limited due to available funding, and
credentialing limitations of instructional school staff; and
WHEREAS, at the January 31, 2014 Commission Retreat, the City's Key Intended
Outcomes (KIO) in the Strategic Plan were updated to reflect the priority outcomes of the Mayor
and City Commission, and was formally adopted on March 5, 2014 pursuant to Resolution No.
2014-28525; and
WHEREAS, Resolution No. 2014-28525 supports the KIO to "Induce Public School
Accountability Mainly at Middle School" and to "Achieve Educational K-12 Excellence"; and
WHEREAS, on March 19, 2015, the City, M-DCPS, and FIU executed an agreement
outlining each party's obligations in connection with providing dual enrollment courses for
college credit to students attending MBSHS (the Agreement), with the City contributing a not to
exceed sum of$20,000 for the 2015-2016 Miami-Dade County public school year; and
WHEREAS, on May 26, 2016, the parties executed Amendment No. 1 to the Agreement,
which, in material part, extended the term of the Agreement to June 30, 2017, increased the
City's contribution to the program from $20,000.00 to $40,000.00 for the 2016-2017 Miami-Dade
County public school year, and clarified other expenses and responsibilities related to the
program; and
WHEREAS, prior to the City providing this enhancement, dual enrollment was either not
offered or offered sporadically at MBSH; and
WHEREAS, the interest and success of students at MBSHS in dual enrollment classes
has resulted in a 83 percent increase in the number of courses from 2015-2016 to 2016-2017
school years; and
WHEREAS, the dual enrollment program saves students and parents money, as dual
enrollment students are exempt from paying application, registration, tuition, laboratory, and
special fees if the classes taken are being used toward a high school diploma; and
WHEREAS, following the implementation of the partnership in the Fall of 2014, there
was a financial savings of $440,907.39 to Miami Beach families for those children choosing to
enroll in dual enrollment classes offered at Miami Beach public schools and funded by the City;
and
WHEREAS, the City's anticipated contribution to support and expand the partnership for
the 2017-18 school year, estimated at $62,000, shall be applied toward the benefits and salary
of the Adjunct Instructor, who is not a Miami Beach Senior High School teacher; and toward the
monitoring and oversight fee for a Miami Beach Senior School Teacher, who Is a courtesy
appointment lecturer; and
WHEREAS, MDCPS will contribute approximately $48,720 for textbooks for the 2017-
2018 school year dual enrollment program, based on enrollment of 406 students; and
WHEREAS, the Administration recommends that the Mayor and City Commission
approve, in substantial form, Amendment No. 2 to the Agreement, incorporated herein by
reference and attached hereto as Exhibit "1".
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve and authorize the City Manager to execute, substantially in the
form attached to this Resolution, Amendment No. 2 to the Agreement, dated March 19, 2015,
between the City, the Miami-Dade County School Board, and Florida International University to
provide dual enrollment courses for college credit for 11th and 12th grade students attending
Miami Beach Senior High School; said amendment, in material part, extending the term of the
Agreement to June 30, 2018, and increasing the City's contribution to the program, in an
amount not to exceed $62,000 per fiscal year, commencing with the third year of the program
(2017-2018 school year), subject to budget appropriation.

RECOMMENDATION
As shown on the Attachment, this initiative has been supported by drawing of prior year available
balances in the Education Compact Fund, an approach that is not sustainable for the long term.
Based on initiatives already underway, there is a need for an additional $300,000 recurring annually,
above the funding available for the Compact. This enhancement currently provides 11th and 12th
grade students at Miami Beach Senior High School access to dual enrollment courses for both
college and high school credit in support of our Education Compact, at an anticipated cost of
$62,000 for the 2017-18 school year.
ANALYSIS
The City of Miami Beach has supported dual enrollment at Miami Beach Senior High School
since Spring 2015. Prior to the City providing this enhancement, dual enrollment was not
offered at the high school or offered sporadically.
The interest and success of students at our high school in dual enrollment classes has resulted
in a 83 percent increase in the number of courses from the 2015-16 to 2016-17 school years.
The chart below provides information on the number of course and class sections available to
students following the implementation of the partnership in Fall 2014, as well as the financial
savings to Miami Beach families for those children choosing to enroll in Dual Enrollment
classes offered at Miami Beach public schools funded by the city. The chart also reflects the

hour rates.

Funding to support and expand the partnership in the 2016-17 school years includes an
estimated City contribution of $39,765 for instructor salaries and MDCPS contribution of
$38,640 for textbooks. Anticipated contributions for the 2017-18 school year are estimated at
$62,000 for the City and $48,720 MDCPS for textbooks.
The dual enrollment program at Miami Beach Senior High School and Nautilus Middle School
allows eligible students to enroll in a college course and high school class simultaneously. The
credits the students earn are used toward both a high school diploma and are acceptable
towards a college Associate or Bachelor degree, or technical certificate. The benefits of
offering dual enrollment courses to high school students include:
• Saves students and parents money, as dual enrollment students are exempt from paying
application, registration, tuition, laboratory, and special fees if the classes taken are being
used toward high school graduation
• Enriches the course opportunities for outstanding high school students
• Shortens the time to attain a college degree
• Provides students with college credit that is transferable to a college or university
• Allows grades earned to become part of the students' permanent

City Education Funding
In Fiscal Year (FY) 2016/17, the City's expenditures to support and enhance educational
programming in Miami Beach public schools amount to approximately $354,000, offset by
approximately $100,000 in dedicated funding through the Education Compact Fund and
contributions and $119,000 in General Fund support (See Attachment). In FY 2017/18, these
expenditures are anticipated to increase to $434,000, offset by approximately $100,000 in
dedicated funding through the Education.Compact Fund.
As shown on the Attachment, these efforts have been supported by drawing of prior year
available balances in the Education Compact Fund, an approach that is not sustainable for the

This Amendment No. 2 (Amendment) to the Agreement, dated March 19, 2015, by and
between the City of Miami Beach, Florida, a municipal corporation organized and
existing under the laws of the State of Florida, having its,principal place of business at

RECITALS

Beach Senior High,School;and
WHEREAS,' on March 19, 2015, CMB, M-DCPS, and FIU executed an
agreement outlining each party s obligations in`.connection with providing dual enrollment
courses:,for college credit to 'students attending,Miami Beach Senior High School (the
Agreement or agreement), with CMB contributing a not to exceed sum of$20,000 for the
2015-2016 Miami-Dade County public school year; and
WHEREAS, on May 26, 2016;. the parties executed the Amendment No. 1 to the
Agreement, which, in material part, extended the term of the Agreement to June 30,

material part, extending the term of the Agreement to June 30, 2018 and increasing
CMB's program contribution to $62,000 for the 2017-2018 school year, for a total
contract contribution not to exceed $122,000.
NOW THEREFORE, in consideration of the mutual promises and conditions
contained herein, and other good and valuable consideration, the sufficiency of which is

hereby acknowledged, the City, M-DCPS and FIU hereby agree to amend the
Agreement as follows:
1. ABOVE RECITALS.
The above recitals are true and correct and are incorporated as part of this
Amendment.
2. MODIFICATIONS.
The Agreement is hereby amended (deleted items struck-through and inserted
items underlined)as follows:
(a) The first recital of the Agreement is hereby amended as follows:
WHEREAS, FIU and M-DCPS entered into an inter-institutional agreement
on October 3, 2013 (the "M-DCPS-FIU Agreement") to promote educational
opportunities through the dual enrollment program in Miami-Dade County
which is attached as Appendix A and incorporated herein by reference;and
(b) Section 1.01 of the Agreement is hereby deleted in its entirety and replaced
with the following:
1.01 Recitals. The parties agree that the foregoing recitals are true
and correct and that such recitals are incorporated herein by reference.
Accordingly, all of the provisions of the M-DCPS-FIU Agreement are
incorporated by reference into this Agreement.
(c) All references in the Agreement to "Exhibit A" are hereby replaced with
"Attachment A". Exhibit A is hereby deleted in its entirety and replaced with
Attachment A, incorporated herein by reference and a copy of which is
attached hereto.
(d) Section 1.02.of this Agreement is hereby deleted in its entirety and replaced
with the following:
1.02 Adjunct Instructor: The appointment and credentialinq of
instructional staff at Miami Beach Senior High School, which may include FIU
Professors or courtesy appointment lecturers such as Miami Beach Senior
High School Teachers, CMB Residents or CMB Employees, shall be provided
in the Agreement, except that pursuant to the Subsection 2.03 below, FIU
shall provide priority to applicants for Adjunct Instructor positions, as follows:
first, Miami Beach Senior High School Teachers; second at the High School,
FIU Professors; third, CMB Residents; and fourth CMB Employees.
(e) The first full paragraph of Section 2.01 of the Agreement is hereby deleted in
its entirety and replaced with the following:
2.01 Term of Agreement. The term of this Agreement shall be
effective as of the last date signed by all parties through the 30th of June,
2018, unless the agreement is terminated earlier pursuant to Section 3.02
below or the M-DCPS-FIU Agreement is terminated. This Agreement may be

renewed for additional periods of time upon the mutual written consent of the
parties and subject to such terms and conditions as the parties shall
determine in writing.
(1) Section 2.02 is hereby deleted in its entirety and replaced with the following:
2.02 Joint Responsibilities. M-DCPS, CMB and FIU shall maintain
responsibility for implementing the various components of this Agreement,
subject to the provisions of the M-DCPS-FIU Agreement, as said Agreement
may be amended from time to time. In the event that there is a conflict
between the provisions of this Agreement and the M-DCPS-FiU Agreement,
the provisions of this Agreement shall govern.
(g) Section 2.03 (B) of the Agreement is hereby deleted in its entirety and
replaced with the following:
B. Payment.The fees for the dual enrollment classes will be allocated as follows:
1. M-DCPS shall pay FIU a non-refundable$3,500(Term Oversight Fee)per
term monitoring and oversight fee. M-DCPS will pay FIU the benefits
(Benefits)portion of the compensation for the Adjunct Instructor(excluding a
Miami Beach Senior High School Teacher), in the amount of$382.50(7.65
percent of the Adjunct Instructor Salary)per instructor, for each school year.
2. M-DCPS shall pay FIU $5,000.00(Adjunct Instructor Salary)for each Adjunct
instructor(except a Miami Beach Senior High School Teacher)to teach a
dual enrollment course at Miami Beach Senior High School for each school
year. M-DCPS shall pay FIU a Fee of$1,500.00(MBSHST Oversight Fee)
per course for academic monitoring and oversight per unique dual enrollment
course taught by a Miami Beach Senior High School Teacher,who serves as
a courtesy appointment lecturer for FIU. The MBSHST Oversight Fee shall be
waived when an Adjunct Instructor(other than a Miami Beach Senior High
School Teacher)teaches a dual enrollment course.
3. CMB shall reimburse M-DCPS for the Benefits and Adjunct Instructor Salary
described in the preceding subsections 2.03(B)(1-2). With respect to an
Adjunct Instructor who is a Miami Beach Senior High School Teacher, CMB
shall not be responsible for reimbursing M-DCPS for the Benefits or the
Adjunct Instructor Salary, but shall be responsible for reimbursing M-DCPS
the MBSHST Oversight Fee, described in subsection 2.03(B)(2), per unique
dual enrollment course taught at Miami Beach Senior High School,
regardless of how many classes are taught. The total amount of
reimbursements paid by CMB under this Agreement(CMB Contributions),
shall be paid within thirty(30)days from receipt of a detailed invoice from M-
DCPS, setting forth the breakdown of the charges and the number of
registered students for each course. CMB Contributions shall not exceed
$62,000.00 in a given fiscal year(from October 1 of a given year to
September 30 of a subsequent year)and shall be subject to budget

appropriation and funding approval by the City Commission for each fiscal
year.
4. M-DCPS shall pay all student instructional material costs, with an anticipated
cost of$18,000.00(in Spring of each school year based upon 150 enrolled
students in six(6)dual enrollment classes).
(g) Footnote 1, referenced on page 4 of the Agreement is hereby deleted in its
entirety.
(h) New Sections 2.03(0), entitled "Policies and Procedures at the High School",
and 2.03 (E), entitled "Course Selection and Scheduling", are hereby added
to the Agreement, as follows:
D. Policies and Procedures at the High School. Prior to commencing any
class at the High School, an Adjunct Instructor shall meet with the
principal of the High School to discuss and acknowledge any site specific
policies and procedures of the High School, including, without limitation,
-the Miami-Dade County public school attendance policies and
procedures, with which the Adjunct Instructor shall comply.
E. Course Selection and Scheduling. The High School principal shall
select the dual enrollment courses to be taught at the High School, so
long as the selected course is one of the dual enrollment courses
identified in Attachment C to the M-DCPS-FIU Agreement. The dual
enrollment course shall be scheduled in accordance with the Miami-Dade
County public school year calendar.
3. RATIFICATION.
Except as amended herein, all other terms and conditions of the Agreement shall
remain unchanged and in full force and effect. In the event there is a conflict
between the provisions of this Amendment and the Agreement, the provisions of
this Amendment shall govern.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment to be
executed by their appropriate officials, as of the date first entered above.

This Amendment No. 1 (Amendment) to the Agreement, dated January 4, 2017,
