CUTLER BAY, FLORIDA, SUPPORTING THE LEGALIZATION AND
REGULATION OF MARIJUANA FOR RECREATIONAL USE; PROVIDING FOR
TRANSMITTAL; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.

Miami Beach Mayor and Commissioners.

RESOLUTION NO. 19-52
A RESOLUTION OF THE MAYOR AND TOWN
COUNCIL OF THE TOWN OF CUTLER BAY,
FLORIDA, SUPPORTING THE LEGALIZATION AND
REGULATION OF MARIJUANA FOR
RECREATIONAL. USE; PROVIDING FOR
TRANSMITTAL; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,there has been a shift in the public opinion regarding marijuana use; and
WHEREAS, in Florida, marijuana for medical use is legal but recreational use remains
illegal; and
WHEREAS, the legalization concerning the recreational use of marijuana needs to be
changed and updated to reflect the growing social acceptance of marijuana and benefit from the
potential revenue that will be generated by a `legal-and-tax regime'; and
WHEREAS, in 2016, the Tax Foundation estimated that states would potentially reap
billions in tax revenue if they moved to a legalize-and-tax-regime"- a 20% sales tax across the
board; and
WHEREAS, the Town Council finds that the adoption of this Resolution is in the best
interest and welfare of the residents of the Town.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND TOWN
COUNCIL OF THE TOWN OF CUTLER BAY,FLORIDA,AS FOLLOWS:
Section 1. Recitals. The above recitals are true and correct and are incorporated herein
by this reference.
Section 2. Support. The Town Council supports the legalization and regulation of
marijuana for recreational use.
Section 3. Transmittal. The Town Clerk is hereby directed to.transmit a copy of this
Resolution to: Governor Ronald Dion DeSantis; State Senate President; State Speaker of the House;
Miami-Dade County Legislative Delegation; Florida Department of Agriculture and Consumer
Services Commissioner, Nicole `Nikki" Fried; Florida Department of Agriculture and Consumer
Services Commissioner, Director of Cannabis, Holly Bell; and all municipalities in Miami-Dade
County.
Section 4. Severabilif. If any section, clause, sentence, or phrase of this resolution is
for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this resolution.

Section 5. Effective Date. This Resolution shall be effective immediately upon
adoption.
