Morales, City Manager DATE: March 11, 2020 SUBJECT: Imposition of Measures During HigN Impact Period - Week 2 This letter shall serve to provide formal notification to the Mayor and City Commission of those actions to be taken by the City Manager to invoke certain provisions of the City's Ordinance regarding High Impact Periods within High Impact Zones, as set forth in Section 82-443 of the City Code, for the second weekend of Spring Break 2020. Due to the anticipated attendance and number of visitors to the City for the upcoming week of Spring Break 2020, I am imposing the following high impact period measures in order to protect the health, safety and welfare of the general public, as well as to protect public and private property from damage, property degradation and/or unauthorized uses. Pursuant to the authorization provided by Resolution No. 2020-31191, which was passed and adopted by the City Commission at its February 26, 2020 meeting, the duration of the following immediate high impact measures shall be from Friday, March 13, 2020 at 7:00a.m. through Wednesday, March 18, 2020 at 7:00a.m. Those measures to be imposed throughout the duration of the High Impact Period, as identified above, shall include: • Ocean Drive will be closed to vehicular traffic from Friday, March 13, 2020, at 7:00a.m. through Wednesday, March 18, 2020 at 7:00a.m.; • The prohibition of coolers and any inflatable devices on public beach property; • The prohibition of tents, tables, and similar structures; • The limitation of live or amplified music, which shall include the suspension of the noise exemption set forth in Section 46-157 of the City Code for those properties located from 9" Street to 11 Street on the west side of Ocean Drive, unless otherwise authorized by a Special Event permit; 1 • The pro hibition of any direct or indirect consum ption of alcohol on public beach pro perty, unless otherw ise authorized by a Special Event perm it; • The im plem entation of a license plate reader police detail; • The suspension of all business tax receipt(s) issued to pro m oters fo r any dance or entertainm ent event(s) to be held at an alcoholic beverage establishm ent located in the M X E m ixed use entertainm ent district (excluding th e porti on of th e M X E located betw een 73° and 75 Streets) or in that portion of the CD-2 commercial, medium intensity district between Pennsylvania Avenue and Collins Court, from 5" Street to 16 Street; • The suspension and closure of all sidewalk café activities and operations at Midnight (12:00am) each evening for the duration of the High Impact Period, as identified previously herein. These high impact period measures shall become part of the Incident Action Plan for Spring Break 2020, to be published by the Department of Emergency Management. Moreover, the City's Police, Fire, Parking and Code Compliance Departments, as well as the Sanitation and Beach Maintenance Divisions, are authorized to implement additional operational measures, as necessary. Any violation of the imposed high impact period measures shall be punished as provided in Section 1-14 of the City Code. This notification shall be filed with the City Clerk, provided to appropriate news media for publication (including local radio and television stations for broadcast), and posted on the City's website, in compliance with Section 82-443(c) of the City Code. Note: Pursuant to Ordinance No. 2020-4333, the sale and/or serving of any alcoholic beverage(s) shall be prohibited from 3 a.m. until 8 a.m., commencing March 13, 2020 and concluding March 19, 2020, by any alcoholic beverage establishment located in either of the following districts: A. The MXE mixed use entertainment district, excluding that portion of the MXE district located between 73rd and 75th Streets; or That portion of the CD-2 commercial, medium intensity district located between Pennsylvania Avenue and Collins Court, from 5th Street to 16th Street. 2
