SUBJECT: Rue Vendome Plaza-Project Update
The purpose of this Letter to Commission is to update the Mayor and City Commission on the status of the project to construct a public plaza at Rue Vendome, adjacent to the Normandy Fountain, in North Beach.
On March 3, 2020, the City started construction to permanently close (to vehicular traffic) that portion of Rue Vendome between 71 Street and Normandy Drive, and create a public plaza which will extend to the area around the Normandy Fountain. Construction on the project has endured delays due to unforeseen utility conflicts, delays in manufacturing, labor shortages due to COVID-19, and additional scope to replace the fountain pump and filtration system. The project is currently ninety percent complete.
New curbs and gutters, concrete pavement and sidewalks, pavers, alteration of the on-street parking, pedestrian crossings and traffic signals, and asphalt restoration, have been completed. Lighting and some of the landscaping (trees, shrubs and sod) have been installed. The western portion of the plaza has been open to the public since May 9, 2021. Several events were hosted in the plaza area by the Normandy Fountain Business Association, between May 9, 2021 and July 22, 2021.
Construction of the project was affected by delays in the delivery of the electrical control panel for the fountain pump and filtration system. The panel which was scheduled to be delivered in 6-8 weeks, required 16 weeks for manufacture and delivery. The contractor demobilized from the site during this extended period, but the electrical control panel has since been delivered and installed.
The contractor, who has not returned to the site to complete the remaining scope of work, was placed in default of the terms of the contract on July 7,2021 and given 21 days to cure the default. The contractor failed to cure the default, therefore the City notified the contractor's bonding company. A Performance and Payment Bond is a requirement of the City's construction contracts to protect the City in the event the contractor fails to completely execute the contract. The bonding company has communicated their commitment to working with the City to complete the project. The City Attorney's office and Administration are currently working with the bonding company to finalize the pending work scope and come to an agreement on the schedule and release of payments. Once the agreement with the bonding company is finalized, the contractor will remobilize to complete the work. The completion of the scope of work is anticipated to take 60 days once work resumes.
Community events are scheduled to resume September 12, 2021 and will be accommodated within the western portion of the plaza until construction is complete. Construction of the project is expected to be completed by December 2021.
