SUBJECT: Motion by the LGBTQ Advisory Committee
The purpose of this Letter to Commission (L TC) is to inform the Mayor and the Commission of the
motion made by the LGBTQ Advisory Committee at their meeting on October 12, 2021,
MOTION:
The LGBTQ Advisory Committee recognizes the challenges of obtaining our medications and the
importance to our community of having access to a 340B Pharmacy connected to our medical
providers, Care Resource is currently a doctor's office located at 1680 Michigan Avenue, serving all
of our community which will benefit from having a pharmacy on site. Therefore, the Committee
motioned to recommend that the Mayor and Commission pass on first reading at the October 13,
2021 Commission meeting and subsequently on second reading at the December 8, 2021
Commission meeting, the item as follows: "NEW OVERLAY -MEDICAL CANNABIS TREATMENT
CENTERS AND PHARMACY STORES AN ORDINANCE OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING THE CODE OF THE CITY
OF MIAMI BEACH, SUBPART B, ENTITLED "LAND DEVELOPMENT REGULATIONS," BY
AMENDING CHAPTER 142 OF THE CITY CODE ENTITLED "ZONING DISTRICTS AND
REGULATIONS," ARTICLE V, ENTITLED "SPECIALIZED USE REGULATIONS," DIVISION 10,
ENTITLED "CONTROLLED SUBSTANCES REGULATIONS AND USE," BY AMENDING SECTION
142-1502, ENTITLED "ZONING DISTRICTS ALLOWING MEDICAL CANNABIS TREATMENT
CENTERS, PHARMACY STORES, AND RELATED USES, PROHIBITED LOCATIONS, AND
NONCONFORMING USES," TO CREATE A NEW AREA WHERE SUCH USES MAY BE
PERMITTED, PROVIDED THAT THE PROPOSED USE MEETS CERTAIN ELIGIBILITY CRITERIA;
AND PROVIDING FOR CODIFICATION, REPEALER, SEVERABILITY, AND AN EFFECTIVE
DATE", which supports the opening of Care Resource's non-profit pharmacy.
