Hudak, City Mana e DATE: March 15, 2022 LETTER TO COMMISSION rs of the City Commission SUBJECT: Miami-Dade County Board of County Commissioners approve Fifth Amendment to the lnterlocal Agreement between the Miami Beach Redevelopment Agency, the City of Miami Beach, and Miami-Dade County The purpose of this Letter to the Commission ("L TC") is to provide an update on the status of the Fifth Amendment to the lnterlocal Agreement between the Miami Beach Redevelopment Agency (RDA), the City of Miami Beach (the "City"), and Miami-Dade County (the "County"), as it relates to the Miami Beach Convention Center Project Final Settlement Agreement {the "Settlement Agreement"). On January 20, 2022, the City Commission and RDA Board approved the Fifth Amendment to the RDA lnterlocal Agreement and authorized its transmittal to the County for consideration. On March 8, 2022, the Fifth Amendment was reviewed and favorably recommended by the County Airports and Economic Development Committee. Earlier today, the Board of County Commissioners approved the Fifth Amendment (12-1). The Fifth Amendment provides for the City to access $27.1 million of excess RDA Trust Fund revenues, to fund or reimburse the City for payments related to the Settlement Agreement, which was approved by the City Commission on September 30, 2021 through Resolution No. 2021-31870. Based on the City's $33.5 million financial obligation and payment schedule, detailed in the Settlement Agreement, $19.2 million has been paid to Clark Construction Group, LLC from construction retainage and temporary appropriations. With County approval of the Fifth Amendment, the Administration will now prepare budget amendments to appropriate the $27.1 million in excess RDA Trust Fund revenues and reappropriate funds temporarily appropriated to ensure timely payments as stipulated by the Settlement Agreement. The budget amendments will be presented to the City Commission and RDA Board for approval on April 6, 2022. The Fifth Amendment also stipulates that the County's annual $1 .5 million set aside of excess Trust Fund revenues may be utilized to fund beach renourishment for any beaches within Miami-Dade County, instead of only beaches adjacent to Miami Beach. Special thanks to Mayor Gelber and Commissioner Fernandez for attending the meeting at Miami-Dade County and all County Commissioners who advocated and supported the Fifth Amendment. Their combined efforts contributed greatly to the successful approval. In addition, I would like to acknowledge my Executive Team, the City Attorney's Office, the Economic Development Department, the Office of Management and Budget, and the G.O . Bond Program Office for their steadfast efforts to the success of this amendment. The Administration continues to work with Clark Construction to achieve Final Certificate of Occupancy for the Miami Beach Convention Center .
