A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
HALLANDALE BEACH, FLORIDA OPPOSING FLORIDA HOUSE BILL 37 AND
FLORIDA SENATE BILL 774, REQUIRING LOCAL ELECTED OFFICIALS TO
FILE ADDITIONAL PERSONAL FINANCIAL DISCLOSURES; AND PROVIDING
FOR AN EFFECTIVE DATE.
Resolution 2023-036:
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
HALLANDALE BEACH, FLORIDA OPPOSING FLORIDA HOUSE BILL 401 AND
FLORIDA SENATE BILL 604, INCREASING THE STATUTORY LIMITS ON
LIABILITY FOR TORTS CLAIMS AGAINST LOCAL GOVERNMENT; AND
PROVIDING FOR AN EFFECTIVE DATE.

7 REQUIRING LOCAL ELECTED OFFICIALS TO FILE
8 ADDITIONAL PERSONAL FINANCIAL DISCLOSURES; AND
9 PROVIDING FOR AN EFFECTIVE DATE.

RESOLUTION NO. 2023- 035
11 WHEREAS, on December 7, 2022, Florida Representatives Spencer Roach, Linda
12 Chaney and Mike Giallombardo filed House Bill 37 (HB 37), which would require city and county
13 electd officials and manager to file an annual full disclosure of financial interests form (Form 6)
14 rather than the currently required limited disclosure of financial interests form (Form 1); and
15
16 WHEREAS, companion Senate Bill 774 (SB 774) was filed by Florida Senator Jason
17 Brodeur; and
18
19 WHEREAS, unlike statewide elected officials or even county elected officials, many
20 municipal elected officials are part-time officials making little or no money at all from their public
21 service and already disclose significant assets, liabilities and sources of income annually; and
22
23 WHEREAS, the Mayor and City Commission find that it is in the best interest of the
24 residents of the City of Hallandale Beach to oppose HS 37 and SB 774 requiring additional
25 personal financial disclosures from municipal elected officials.

27 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
28 COMMISSION OF THE CITY OF HALLANDALE BEACH, FLORIDA:

30 SECTION 1. The foregoing "Whereas" clauses are incorporated herein.

32 SECTION 2. The Mayor and City Commission hereby oppose HB 37 and SB 774
33 requiring additional personal financial disclosures from municipal elected officials.

35 SECTION 3. Effective Date. This Resolution shall take effect immediately upon its
36 passage and adoption.

12 WHEREAS, on February 2, 2023, Florida Representative Mike Beltran file House Bill
13 401 (HB401 ), which would increase the statutory maximum amount that local government is
14 liable to pay for a claim or judgment from $200,000 per person and $300,000 per incident to
15 $2.5 million per person and $5 million per incident; and
16
17 WHEREAS, on February 8, 2023 Florida Senator Joe Gruters filed Senate bill 604 (SB
18 604), which would increase the statutory maximum amount that a local government is liable
19 to pay for a claim or judgment from $200,000 per person and $300,000 per incident to
20 $400,000 per person and $600,000 per incident, and providing for annual increase in the
21 amounts for inflation; and
22
23 WHEREAS, if the bills pass, local governments would need to budget more money to
24 pay higher insurance premiums or, for those that are in whole or in part self-insured, to pay
25 for the expected increased number of lawsuits and higher settlements and/or judgments; and
26
27 WHEREAS, local governments will have to increase taxes, increase fees and rates
28 and/or reduce services to pay for increased costs, all burdens that will be placed on Florida
29 taxpayers; and
30
31 WHEREAS, the Mayor and City Commission find that it is in the best interest of the
32 residents of the City of Hallandale Beach to oppose House Bill 401 and Senate Bill 604
33 increasing the statutory limits on liability for tort claims against local governments.

35 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
