SUBJECT: Art in Public Places Committee Motions-June 20, 2023
The purpose of this letter to the Mayor and Commission is to provide an update regarding
two motions made during the June 20, 2023 Art in Public Places ("AIPP") Committee
meeting.
1. Proposed Art in Public Places Ordinance Amendment (Maintenance Restrictions)
Motion to support amending Section 82-588 of the Art in Public Places Ordinance,
to remove the 25 percent limit on the amount budgeted for administration,
maintenance, insurance, and preservation of works of art acquired by the City.
The above motion was made by Sara de los Reyes, seconded by Ann-Kathrin Seif and
approved unanimously by Marcella Novella (Chair), Nick D'Annunzio, Aaron Resnick,
and Yolanda Sanchez.
As the Ordinance currently reads, "All such expenses shall be approved as part of the
yearly budget for the fund by the city commission after considering the recommended
budget submitted by the city manager and the committee. The amount budgeted for
administration, maintenance, insurance, and preservation of works of art acquired by the
city pursuant to this article as part of the total appropriations for art in public places shall
not be more than 25 percent of monies placed in the art in public places fund."
The proposed amendment would remove the 25 percent limit, as noted above.
The AiPP program is funded by 2% of all hard costs of City projects, including new
construction, additions, and costs for construction of joint private/public projects. The fund
is used for the commission or acquisition of works of art; conservation and maintenance
of works of art; research and evaluation of works of art; printing and distribution of related
materials; and administration. Due to the nature of its funding structure, the Art in Public
Places fund varies significantly each fiscal year.
Currently, the Art in Public Places fund has a balance of $101,000, as presented at the
internal budget meeting. It is expected to receive a $167,00 contribution later this year due
to the Maurice Gibb Park project.
The annual maintenance projection is estimated to be $60,000. Projected maintenance
expenditures for FY 24 will be $60,000. By removing the twenty-five percent limit, the Art
in Public Places Fund would have the ability to provide adequate and consistent funding
for the maintenance and preservation of the public art collection.

2. Julio Cesar, "Sculpture-Ocean Drive LGBTQ+ Pride"
Motion to thank Julio Cesar for conceptualizing the proposal; however, Art in
Public Places does not have the funding to support this project.
The above motion was made by Sara de los Reyes, seconded by Marcella Novela and
approved unanimously by Nick D'Annunzio, Aaron Resnick, Ann-Kathrin Seif and
Yolanda Sanchez.
On May 23, 2023, the Public Safety and Neighborhood Quality of Life Committee
referred an item to the Art in Public Places Committee regarding a possible LGBTQ+
Rainbow Sculpture in Lummus Park.
On March 13, 2023, Julio Cesar submitted an unsolicited proposal to the City of Miami
Beach entitled "Sculpture-Ocean Drive LGBTQ+ Pride." The proposed 20' rainbow
shaped sculpture is composed of concrete and detailed in bronze. The artist included a
cost estimate of $386,631.00.

Aaron Resnick, Yolanda Sanchez and Ann-Kathrin Seif.
