Declaration of a State of Emergency Relating to Hurricane IanCITY OF MIAMI BEACH DECLARATION OF A STATE OF EMERGENCY RELATING TO HURRICANE IAN WHEREAS, Section 252.38(3)(a), Florida Statutes, grants authority to political subdivisions (including municipalities) to exercise certain emergency management powers to provide for the health and safety of persons and property; and WHEREAS, Chapter 26 of the Miami Beach City Code ("City Code") grants the City Manager the authority to declare a State of Emergency in Miami Beach, and authorizes the City Manager to order certain measures in response to the emergency; and WHEREAS, on September 23, 2022, Governor Ron Desantis issued Executive Order 22- 218, declaring a State of Emergency for 24 counties in the potential path of Tropical Depression Nine (now known as Hurricane Ian), including Miami-Dade County; and WHEREAS, Hurricane Ian is expected to impact the City of Miami Beach (the "City") and create weather conditions, including the possibility of flooding in low-lying areas of the City, that may require extraordinary and immediate actions by the City in order to protect the public health, safety and general welfare of the community; and WHEREAS, I have determined that the threats associated with Hurricane Ian have created conditions that constitute an imminent threat to the general welfare of the City of Miami Beach, and desire to issue this Declaration in the best interest of the City and in order to take all steps necessary to obtain reimbursement for storm preparation and other expenses incurred in connection with this emergency. THEREFORE, as City Manager of the City of Miami Beach, I hereby declare a State of Emergency throughout the territorial jurisdiction of the City of Miami Beach, effective September 27, 2022, at 1 :00 p.m., which will continue for 72 hours unless canceled before that time, or extended by the City Commission. Pursuant to this Declaration and Chapter 26 of the City Code, I may issue emergency orders as may be necessary to protect the health, safety, and welfare of the community.
